2002-24929 Reso RESOLUTION NO. 2002-24929 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER PERTAINING TO THE RANKING OF QUALIFICATIONS RECEIVED PURSUANT TO REQUEST FOR QUALIFICATIONS (RFQ) NO. 31-01/02 FOR DESIGN AND CONSTRUCTION ADMINISTRATION SERVICES NEEDED TO COMPLETE THE. VENETIAN ISLANDS NEIGHBORHOOD RIGHT OF WAY IMPROVEMENT PROJECT (PHASE I); AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE TOp. RANKED FIRM OF KUNDE SPRECHER & ASSOCIATES, INC.; AND, SHOULD THE ADMINISTRATION NOT BE ABLE TO NEGOTIATE AN AGREEMENT WITH THE TOP-RANKED FIRM, AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH THE SECOND-RANKED FIRM OF WILLIAMS HATFIELD AND STONER; AND, SHOULD THE ADMINISTRATION NOT BE ABLE TO NEGOTIATE AN AGREEMENT WITH THE SECOND-RANKED FIRM, FURTHER AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH THE THIRD-RANKED FIRM OF MARLIN ENGINEERING. WHEREAS, on April 10, 2002, the City Commission authorized the issuance of a Request for Qualifications from Professional Architectural/Engineering firms to validate planning efforts undertaken to date and to complete the 30% level construction documents for Phase 1 of the Venetian Islands Neighborhood Improvements Project - consisting of San Marino, Rivo Alto, DiLido, and Belle Islands including Belle Isle Park; and WHEREAS, a total budget of $11,457,576 has been identified from the General Obligation Bond Fund, the Series 2000 Water and Sewer Bond Fund, and the Series 2000 Stormwater Bond Fund; and WHEREAS, RFQ No. 31-01/02 was issued by the City on April 19, 2002 with an opening date of May 17, 2002; and WHEREAS, seven (7) firm submitted proposals in response to the RFQ: . Schimpeler Mirson / American . Carney-Neuhaus, Inc. . Craig A. Smith & Associates . H.J. Ross and Associates . Kunde Sprecher & Associates, Inc. . Marlin Engineering . Williams Hatfield and Stoner; and -= WHEREAS, an Evaluation Committee was appointed by the City Manager consisting of the following individuals:" . Donald Shockey, Committee Chair, Senior Capital Projects Planner, CIP Office . Stacy Kilroy, Senior Capital Projects Planner, CIP Office . Michel Magloire, Senior Capital Projects Coordinator, CIP Office . Bruce Katzen, President of Venetian Islands Homeowners Association, Rivo Alto Island Resident . Jorge Kuperman, Di Lido Island Resident . Mirta Fuentes, San Marino Island Resident . Linda Grosz, Venetian Island Resident; and WHEREAS, the Committee listened to a 15 minute presentation and conducted question and answer sessions with each firm, and afterwards ranked the firms as follows: . First: Kunde Sprecher & Associates, Inc. . Second: Williams Hatfield and Stoner . Third: Marlin Engineering; and WHEREAS, the City Manager has reviewed the Evaluation Committee's recommendation, and herein recommends that the Mayor and City Commission enter into negotiations with the first-ranked firm of Kunde Sprecher & Associates, Inc., and if unsuccessful, negotiate with the second-ranked firm of Williams Hatfield and Stoner, and if unsuccessful, negotiate with the third-ranked firm of Marlin Engineering. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein accept the recommendation of the City Manager pertaining to the qualifications received pursuant to Request for Qualifications (RFQ) No. 31-01/02 for Design and Construction Administration Services needed to complete the Venetian Islands Neighborhood Right of Way Improvement Project (Phase I); authorizing the Administration to enter into negotiations with the top -ranked firm of Kunde Sprecher & Associates, Inc., and, should the Administration not be able to negotiate an Agreement with the top-ranked firm, authorizing the Administration to negotiate with the second-ranked firm of Williams Hatfield and Stoner; and, should the Administration not be able to negotiate an Agreement with the second-ranked firm, further authorizing the Administration to negotiate with the third-ranked firm of Marlin Engineering. Procurement staff coordinated and scheduled presentations for July 17, 2002 and July 18, 2002. The Committee convened on July 17th and 18th and were provided presentations by all seven (7) short-listed firms. During deliberations, the Committee members discussed thelr individual ranking of the seven firms and arrived at the following Committee ranking: . First: Kunde Sprecher & Associates, Inc. . ADMINISTRATIVE RECOMMENDATION Adopt the Resolution. ANALYSIS Pursuant to Request for Letters of Interest No. 40-95/96 for Professional Architectural' Engineering Services for Master Planning Improvements for the Venetian Causeway and perimeter roads, the City, on February 13, 1997, entered into an agreement with the Urban Resource Group (URG) to prepare a master plan for Venetian Islands Neighborhood Right of Way Improvement. URG prepared a master plan which was presented to the Finance and Citywide Projects Committee on April 7, 1998, which recommended approval of the plan. The Master Plan was subsequently approved by the City Commission on April 15, 1998. On June 3, 1998, the City Commission authorized Amendment No. 1 to the Agreement with URG to allow them to proceed with land survey services associated with the Master Plan. Commission Memo RFQ 31-01/02 - Design And Construction Administration Services Needed To Complete The Venetian Islands Neighborhood Improvements Project (Phase I) July 31, 2002 Page 2 of 6 On April 12, 2000, the City Commission approved Amendment NO.2 to the Agreement with URG for the provision of additional services related to design, construction documents, additional services and reimbursable expenses associated with Phase 1 of the improvements as defined in the Master Plan. Although funding for the additional services was identified and appropriated in the documentation accompanying the approval of this Amendment, as was a probable cost of the Master Plan improvements, funding sources were not identified to meet the estimated construction costs of the project and no money was appropriated for this purpose. When the City established the Capital Improvement Projects Office in Summer of 2001 , one ofthe Office's first tasks in concert with Hazen and Sawyer, P.C., (Program Manager), was to reconcile project design efforts with available project funding from the General Obligation (G.O.) Bond Program, and the Water and Sewer Bond, for the Venetian Islands water distribution system upgrades. In the course of this work, it was determined that the funds available for construction for the Venetian Islands Right of Way Improvement Project were substantially less than the budget amount that URG was using as a target for designing improvements. The City entered into good faith negotiations with URG to revise the Professional Services Agreement, scope of services, and consultant fee amount to match actual project funding. Unfortunately, the City and URG could not reach an agreement for these necessary revisions to the original design contract. On February 11, 2002, the City exercised its right per Section 10.2 of its Agreement with URG to terminate the Agreement for convenience. At the time of termination , construction designs for the project were approximately 30% complete. On April 10, 2002, the Administration authorized the issuance of a Request for Qualifications from Professional Architectural/Engineering firms to validate planning efforts undertaken to date and to complete the 30% level construction documents for Phase 1 of the Venetian Islands Neighborhood Improvements Project - consisting of San Marino, Rivo Alto, DiLido, and Belle Islands including Belle Isle Park. Additionally, they discussed the following RFQ evaluation criteria, which were used to evaluate and rank the respondents: . Ability of Professional Personnel. . Past Performance. . Willingness to Meet Time and Budget Requirements. . Location. . Recent, Current and Projected Workload of the Firm. . Volume of work previously awarded to each firm by the agency, with the object of effecting an equitable distribution of contracts among qualified firms. Consensus at the end of the meeting was to invite all seven (7) firms to provide a 15 minute presentation, followed by a 15 minute question and answer session. Procurement staff coordinated and scheduled presentations for July 17, 2002 and July 18, 2002. The Committee convened on July 17th and 18th and were provided presentations by all seven (7) short-listed firms. One Committee member, Linda Grosz, was excused from deliberating and voting due to her absence from the meeting held on July 17, 2002.
