97-22395 RESO RESOLUTION NO. 97-22395 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER PUBLIC COMMENT REGARDING AN AMENDMENT TO THE GROUND LEASE BETWEEN THE CITY AND THE MIAMI CITY BALLET, INC.; SAID AMENDMENT, IN PART, CHANGING THE LOCATION OF THE DESIGNATED SITE FOR A PROPOSED MIAMI CITY BALLET FACILITY FROM THE SURFACE LOT EASTERLY OF CONVENTION CENTER DRIVE AND ADJACENT TO THE JACKIE GLEASON THEATER OF THE PERFORMING ARTS, TO A PROPOSED CITY-OWNED SITE IN THE BLOCKS BOUNDED BY COLLINS AVENUE AT 22ND STREET, AND PARK AVENUE, AT 23RD STREET, IN THE COLLINS PARK AREA. WHEREAS, on April!3, 1994, the City and Miami City Ballet, Inc. ("Ballet"), exeClte j a Ground Lease Agreement for a proposed permanent facility for the Miami City Ballet, to be constructed on the City-owned surface lot easterly of Convention Center Drive and adjacent tc tl e Jackie Gleason Theater of the Performing Arts (Designated Site); and WHEREAS, based on a directive from the Mayor and City Commission, the Administrctic n has been working on the various elements to create a cultural center in the vicinity of the Colir s Park Area, which would include siting the proposed Ballet facility with the proposed new regi,)n: ill library, all in the area immediately north of Collins Park; and WHEREAS, pursuant to these discussions, the City and the Ballet now desire to change tl e Designated Site for the Ballet's permanent facility to a proposed new site, to be generally located 0 n property to be acquired by the City in the blocks bounded by Collins A venue, at 22nd Street, an j Park Avenue, at 23rd Street, in the Collins Park Area (New Site); and WHEREAS, as the original Ground Lease Agreement was approved by the Mayor and:i1y Commission with the inclusion of the Designated Site, the City Attorney's Office and the Administration would herein jointly recommend that, pursuant to Ordinance No. 92-2783, whicl establishes procedures for the sale and/or lease of City property and, in part, requires that the May< r and City Commission hold a public hearing advertised not less than fifteen (15) days prior to th.~ hearing in order to obtain citizen input into a proposed sale and/or lease, the proposed Amendmel t to the Ground Lease which, in part, designates the New Site, be subject to this public hearin.~ requirement, so as to fully inform the general public and hear comment as to the proposed acLor . NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CIT"l COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, as follows: 1. A public hearing is scheduled for Wednesday, June 18, 1997 at 1: 45 p.n. to consider public comment regarding an Amendment to the Ground Lease betwee 1 the City and the Miami City Ballet, Inc.; said Amendment, in part, changing th.~ location of the designated site for a proposed Miami City Ballet facility, from tt e surface lot easterly of Convention Center Drive and adjacent to the Jackie Gleaso 11 Theater of the Performing Arts, to a proposed City-owned site in the blocks boundei by Collins Avenue, at 22nd Street, and Park Avenue, at 23rd Street, in the Colirs Park Area. 2. This Resolution shall take effect immediately upon its passage. ADMINISTRA TION RECOMMENDATION: Adopt the Resolution setting the public hearing on June 18, 1997. BACKGROUND: Based on Commission direction, the Administration has been working on the various elements ':0 create a cultural center in the vicinity of Collins Park. This involves siting the Miami City Ball ~t along with the library in the area immediately north of Collins Park. The Ballet has a State grant of$500,000 which hinges on the Ballet having proof of site control. The Ballet currently has a lease with the City of Miami Beach on the east side of Convention Centl~r Drive adjacent to TOP A. The lease must be modified to reflect the new site. AGENDA ITEM 99 ANALYSIS: City Ordinance No. 92-2783, (the Shapiro ordinance) requires a public hearing to consider public: comment as to the potential lease of City property. As the proposed amendment to the curren: ground lease between the City and the Ballet is proposing a site change to the Collins Park area, the City Attorney h.as opined that such a substantive change would require the aforestated complialcl .. with the Shapiro Ordinance set for consideration ofleasing or substantive change to existing lease: of City-owned property.
