A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AN APPROPRIATION
OF $30,000 ($15,000 FROM PARKING ENTERPRISE FUND ACCOUNT
NUMBER 480.0462.000343 AND $15,000, APPROVED HEREIN AS A
DONATION FROM THE FORGE RESTAURANT); FURTHER APPROVING
THE ESTABLISHMENT OF A WORK ORDER FOR PUBLIC RIGHT-OF-
WAY IMPROVEMENTS ON THE SOUTH SIDE OF THE 400 BLOCK OF
41ST STREET, FOR EXPANSION OF THE ROADWAY, TO ALLOW FOR
ON-STREET PARKING (COMMERCIAL/P ASSENGER LOADING ZONES).
WHEREAS, the roadway conditions on the south side of the 400 block of 41 st Street do
not allow for on-street parking (commercial/passenger loading zones); and
WHEREAS, this lack of on-street parking (commercial/passenger loading zones) has
resulted in illegal parking and hazardous conditions for both pedestrians and vehicular traffic;
and
WHEREAS, the Forge Restaurant, located at 432 - 41st Street, has expanded its operations
to include Club Nostalgia and Jimmy'z at Cuba Club; and
WHEREAS, the expansion of the roadway would allow for additional on-street parking
(commercial/passenger loading zones) to service said establishments; and
WHEREAS, the additional on-street parking will better serve the establishments by
providing commercial/passenger loading zones; and
WHEREAS, the establishment of commercial/passenger loading area will enhance public
safety and improve traffic conditions in the vicinity; and
WHEREAS, this matter was heard by the Transportation and Parking Committee at it's
regular meeting on February 1, 1999, and was unanimously approved; and
WHEREAS, there are funds, in the amount of $15,000, in Parking Enterprise Fund Account
Number 480.0462.000343 for said improvements; and
WHEREAS, the Forge Restaurant has agreed to share the cost of said improvements,
estimated in total at $30,000, and the Administration would accordingly recommend that the Mayor
and City Commission herein approve said donation, for the purposes stated herein.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission approve an appropriation of $30,000 ($15,000 from Parking Enterprise Fund Account
Number 480.0462.000343 and $15,000, approved herein as a donation from the Forge Restaurant);
further approving the establishment of a work order for public right-of-way improvements on the
south side of the 400 block of 41 st Street, for expansion of the roadway to allow for on-street parking
(commercial/passenger loading zones).

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
FUNDING:
Funding is available in the amount of $15,000 from Parking Enterprise Fund Account No.
480.0462.000343, and a matching donation, in the amount of$15,000 from the Forge Restaurant.
BACKGROUND:
Currently, the roadway conditions on the south side of the 400 block of 41 st Street do not allow for
on-street parking. This lack of on-street parking has resulted in illegal parking and hazardous
conditions for both pedestrians and vehicular traffic. Due to a lack of commercial/passenger loading
zones in the block, commercial delivery vehicles serving the business district regularly jump the
curb and park on the sidewalk. This practice is unsafe for both pedestrian and vehicular traffic and
it has damaged the sidewalk brick pavers.
The Forge Restaurant, located at 432 41st Street, which includes Jimmy'z at Cuba Club, is
expanding its operations with Club Nostalgia, a supper club. The restaurant/supper club requested
the City to expand the roadway by reducing the width of the sidewalk to provide on-street parking
for commercial/passenger loading needs of the block. Current conditions of providing only forty (40)
feet (two car lengths) ofloading zone to serve a 275 seat restaurant and 150 seat nightclub is severely
deficient. The addition of on-street parking, at this location, will better serve the 41 st Street Business

District by: (l) providing a commercial loading zone for daytime use, and (2) a passenger loading
zone for evening use by the restaurant and club.
This matter was heard by the Transportation and Parking Committee on Monday, February 1, 1999,
and it was unanimously approved.
ANALYSIS:
A. On-Street Parking:
The establishment of a commercial/passenger loading zone, at this location will provide a
needed on-street commercial/passenger zone in the 400 block of 41 st Street and will raise
the level of business in the district.
B. Public Safety:
The establishment of on-street parking on the 400 block of 41 st Street will enhance public
safety. Currently, vehicles wishing to drop-off/pick-up passengers on the 400 block circle
the block seeking an available loading zone. If all loading zones are in use, typically, drivers
will pause in the moving lane of traffic on 41st Street to drop-off/pick-up passengers. This
presents a public safety hazard in the form of passengers exiting/entering vehicles in a
moving lane of traffic. Additionally, commercial vehicles will be prevented from jumping
the curb and parking on the sidewalk will be eliminated. The establishment of on-street
parking (commercial/passenger loading zones) will diminish this activity and enhance public
safety.
C. Traffic Congestion:
Drop-off and pick-up activity in the moving lane of traffic on 41 st Street contributes to traffic
congestion. The pausing of vehicles in a moving lane of traffic for the entry/exit of
passengers from vehicles lowers the level of service of the roadway. In this case, vehicles
tend to queue on the 400 block of 41st Street due to this activity. The establishment of on-
street parking (commercial/passenger loading zones) will help to alleviate traffic congestion
on 41 st Street.
D. Joint Funding (Public-Private Initiative):
The Forge Restaurant will share the cost of said improvements, estimated at $30,000. The
City will provide funding in the amount of$15,000 and the Forge Restaurant will fund the
balance ofthe project ($15,000 and any and all costs over and above $30,000). Any cost
savings realized will be distributed equally between the City and the Forge Restaurant.
E. Scope of Work:
41 st Street (41 st Street) is a state road. FDOT (Florida Department of Transportation) must
review, approve, and issue a permit in order for the City to proceed. The following section
(F) provides an itemized estimate of costs for the project:

CONCLUSION:
The appropriation of $30,000 ($15,000 from Parking Enterprise Fund Account Number
480.0462.000343 and a donation from the Forge Restaurant in the amount of $15,000) and the
establishment of a work order, will enable the Public Works Department to perform the roadway
improvements. Furthermore, the Forge Restaurant is responsible for any and all costs above and
beyond $30,000.
The establishment of on-street parking (commercial/passenger loading zones) on the south side of
the 400 block of 41 st Street should alleviate the demand of the existing commercial/passenger
loading zone(s) on Sheridan Avenue and its vicinity, enhance public safety, and alleviate traffic
congestion.
