A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, APPROVING
AMENDMENTS TO THE 1998 CONCEPT PLAN FOR THE PARCEL
KNOWN AS SSDI NORTH IN ORDER TO ALLOW FOR THE
REMOVAL OF TOWNHOMES AND AN EXPANDED OPEN
PEDESTRIAN PLAZA ALONG ALTON ROAD, AND TO PROVIDE
A LARGER STAIRWAY TO BE LOCATED WITHIN THE BAYWALK
SETBACK AREA WHICH CONNECTS THE PEDESTRIAN PLAZA
TO THE BAYWALK; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on September 23, 1998, the City of Miami Beach and Miami Beach
Redevelopment Agency ("RDA") adopted Resolutions 98-22921 and 302-98, respectively,
approving a Concept Plan under a Settlement Agreement, by and among the City, the
RDA, and West Side Partners, Ltd., (the "1998 Concept Plan"), to resolve pending litigation
on the SSDI North and South parcels located on Alton Road in the South Pointe
Redevelopment Area; and
WHEREAS, a significant element of the 1998 Concept Plan was the view corridor
and pedestrian plaza in the center of the SSDI North site, which was approved with
townhomes along the first level of the east side of the site, fronting Alton Road; and
WHEREAS, on July 16, 2002 the Design Review Board ("DRB") approved the
construction of Phase II of a two (2) phase development project for the SSDI North site
("Phase II"), consisting of a five (5) level parking pedestal with a residential tower above;
and
WHEREAS, as part of the approval of Phase II, and at the request of the applicant
for the development project ("Murano Grande"), additional modifications to the plans
consisting of the removal of the four (4) townhomes along Alton Road and an expanded
pedestrian plaza, were evaluated and approved by the DRB; and
WHEREAS, Condition No. 1.d of the DRB Final Order for the project states the
following: "In the event City Commission approval is required for an amendment to the
[Settlement] Agreement to allow the required townhomes fronting Alton Road to be
replaced with the proposed pedestrian plaza, and the City Commission does not approve
such amendment, the town homes shall be reintroduced, in a manner to be approved by
staff"; and
WHEREAS, the DRB agreed with Murano Grande that the proposed removal of the
subject town homes and the expansion of the pedestrian plaza would improve the view
corridor, and approved the new project subject to this revision; and
WHEREAS, the DRB Final Order for Phase II also required that the west wall at the
first level of the pedestal be further detailed, and that the northern terminus of the Bay
Walk be re-studied and improved in design; and
WHEREAS, in order to address the specific requirements relative to the Bay Walk
and pedestal, the applicant has proposed a more expansive and open stairway connecting
the pedestrian plaza to the Bay Walk.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve an amendment to the 1998 Concept Plan of the Settlement
Agreement, for the SSDI North property, in order to atlow the removal of the four (4)
townhome units on the east side of Phase II of the SSDI North Development Project, and
to provide a larger staircase located within the baywalk setback area, in accordance with
the plans and Final Order approved by the Design Review Board on July 16, 2002 (DRB
File No. 16157).

ANALYSIS
On September 23, 1998, the City of Miami Beach/RDA approved a Concept Plan
pertaining to a Settlement Agreement to resolve pending litigation regarding the SSDI
North and South parcels located on Alton Road in the South Pointe Redevelopment Area.
A significant element of this concept plan was the view corridor and pedestrian plaza in the
center of the SSDI North site, as well as town homes fronting the Alton Road sidewalk
along the east side of the site.
On March 20, 2001 the Design Review Board (DRB) approved phase I of a two (2) phase
development project for the SSDI North site, consisting of a 263 unit, 36 story
condominium with accessory townhomes and marina parking. Phase I has been permitted
and is under construction.
On July 16, 2002 the DRB approved Phase II of the development project for the 5501
North site (DRB File No. 16157), consisting of a five (5) level parking pedestal with a
residential tower above. As part of the approved concept plan for Phase II, four (4)
accessory town homes were required along the east side of the site, fronting the Alton Road
sidewalk. However, as part of the approval of Phase II, and at the request of the applicant
(Murano Grande), the DRB approved the removal of the four (4) townhomes along Alton
Road, as well as an expanded pedestrian plaza. Specifically, condition No. 1.d of the DRB
Final Order for the project states the following:

In the event City Commission approval is required for an amendment to the
Development Agreement to allow the required townhomes fronting Alton Road to
be replaced with the proposed pedestrian plaza, and the City Commission does not
approve such amendment, the townhomes shall be reintroduced, in a manner to be
approved by staff.
The Design Review Board, at the second of two (2) noticed public hearings, agreed with
the applicant for the development that the proposed removal of the subject town homes and
the expansion of the pedestrian plaza would improve the view corridor, and approved the
new project pursuant to this revision. The Planning Department had some reservations
relative to the removal of the town homes, as it would result in the loss of significant scale
and mass along the sidewalk, which is critical in maintaining the pedestrian fabric of the
immediate area, particularly at the pedestal level of the project. However, given the fact
that Phase II of the SSDI North development site is at the extreme end of the South Point
Alton Road corridor, and only a short distance from the MacCarthur Causeway, staff
concluded that the expanded vista into the view corridor offset this concern.
Relative to the expansion of the stairwell into the baywalk setback area, the Final Order for
Phase II also required that the west wall at the first level of the pedestal be further detailed,
and that the northern terminus of the Bay Walk be re-studied and improved in design. In
order to address these specific requirements, the applicant has proposed a more
expansive and open stairway connecting the pedestrian plaza to the baywalk. Such
stairway is more of a clearly identifiable access point and helps to satisfy the specific
conditions in the DRB Final Order.
A courtesy notice for this request has been provided to all property owners within 375
square feet of the subject site.
Based on the foregoing analysis, the Administration recommends that the City Commission
approve an amendment to the Concept Plan to the Development Agreement, by and
among the City, the Miami Beach Redevelopment Agency and South Shore Developers,
Inc. (such amendment being hereinafter referred to as the "1998 Concept Plan") for the
SSDI North property, pursuant to the attached Resolution.
