2002-24955 Reso ~ RESOLUTION NO. 2002.,..l4955~, A RESOLUTION OF THE BOARD OF DIRECTORS OF THE NORMANDY SHORES LOCAL GOVERNMENT NEIGHBORHOOD IMPROVEMENT DISTRICT AMENDING THE PROPOSED MILLAGE OF 0.801 MILLS AND SETTING 1) THE AMENDED PROPOSED GENERAL OPERATING MILLAGE RATE OF 1.194 MILLS FOR THE NORMANDY SHORES LOCAL GOVERNMENT NEIGHBORHOOD IMPROVEMENT DISTRICT; 2) THE CALCULATED ROLLED-BACK RATE; AND 3) THE REVISED DATE, TIME AND PLACE OF THE FIRST PUBLIC HEARING TO CONSIDER THE OPERATING MILLAGE RATE AND BUDGET FOR FISCAL YEAR (FY) 2002/03; FURTHER AUTHORIZING THE CITY MANAGER TO TRANSMIT THIS INFORMATION TO THE MIAMI- DADE COUNTY PROPERTY APPRAISER IN THE FORM REQUIRED BY SECTION 200,065, FLORIDA STATUTES. WHEREAS, for the purpose of providing security services within the Normandy Shores neighborhood area, the Mayor and City Commission adopted Ordinance No. 93-2881 on October 20, 1993, which authorized the creation of the Normandy Shores Local Government Neighborhood Improvement District (District); and WHEREAS, Section 200.065, Florida Statutes, has specified the method by which municipalities may fix the operating millage rate and adopt an annual budget for dependent taxing districts; and WHEREAS, on July 31, 2002, the City Commission adopted Resolution 2002- 24942 which set the proposed operating millage rate for the District at 0.801 mills for the purpose of providing security services within the District; and WHEREAS, the Mayor and City Commission directed the Administration to take the actions necessary to limit the General Fund contributions to 35% of the operating costs of the District as have previously been discussed by the Finance and Citywide Projects Committee; and WHEREAS, the Administration met with the Normandy Shores Local Government Neighborhood Improvement District representatives on August 29, 2002 and they agreed with the Administration's recommendation to amend the enabling ordinance to eliminate the $500 cap on the highest valued home in the District and to amend the proposed millage from 0,801 mills to 1.194 mills; and WHEREAS, the Mayor and City Commission ofthe City of Miami Beach, acting as the Board of Directors of the Normandy Shores Local Government Neighborhood Improvement District propose that the District's General Operating Millage Rate be revised from 0,801 mills to 1.194 mills and that the Rolled Back Rate be set at 0,839 mills; and WHEREAS, to increase the proposed millage, the City must notify the Miami- Dade County Property Appraiser, who will prepare and distribute the required amended notification to each property owner in the District; and WHEREAS, the City of Miami Beach is required to advise the Miami-Dade County Property Appraiser of the Amended Proposed Normandy Shores Neighborhood Improvement District Operating Millage Rate, the Rolled-Back Rate, and the revised date, time, and place of the first public hearing. NOW THEREFORE, BE IT DULY RESOLVED BY THE BOARD OF DIRECTORS OF THE NORMANDY SHORES LOCAL GOVERNMENT NEIGHBORHOOD IMPROVEMENT DISTRICT, that the following recommendations of the Administration be and are hereby ratified for transmittal to the Miami-Dade County Property Appraiser, as specified in Section 200.065, Florida Statutes: (1) Amended proposed Normandy Shores Local Government Neighborhood Improvement District Operating Millage Rate for FY 2002/03 Amended General Operating Millage 1,194 mills (2) "Rolled-Back Rate" 0,839 mills (3) The revised date for the first public hearing on the proposed Normandy Shores Local Government Neighborhood Improvement District operating millage rate and tentative budget for FY 2002/03 shall be held on Monday, September 23,2002 at 5:01 P.M., in the City Commission Chambers, City Hall, 1700 Convention Center Drive, Miami Beach, Florida, PASSED and ADOPTED this 11th day of September. 2 02. Normandy Shores FY 2002/03 Tentative Millage Page Two September 11, 2002 BACKGROUND The Normandy Shores Local Government Neighborhood Improvement District, a dependent taxing district of its principal, the City of Miami Beach, was established in 1994 to provide continual 24-hour security to this gated community; FY 2002/03 represents its ninth year of operation. The district was established by Ordinance 93-2881, and has the authority ..to levy an ad-valorem tax on real and personal property of up to two mills, provided that no parcel of property will be assessed more than $500 annually for such improvements", Based on the January 1, 2002, "Certification of Taxable Values" for the district, the highest taxable property assessment within the district is valued at $624,003, which requires a millage rate of 0,801; this millage yields an assessment of $500, During FY 1998/99, the amount of annual funding to be provided by the City and the dependent status of the District were issues discussed by the Finance and Citywide Projects Committee. A determination was reached that the City would fund 35% of the annual cost of the operation of the community guard gate. This cost will eventually be funded from the golf course operation of the Normandy Shores Golf Course rather than the General Fund, At the July 31, 2002 Commission meeting the Mayor and Commission adopted Resolution 2002-24942, which set the proposed operating millage rate for the District at 0.801 mills. At this millage, in accordance with the enabling legislation no property owner's tax would exceed $500. The tax levy at .801 mills would have generated proceeds of $52,310 of the $120,000 operating budget to provide security services for the district. The difference between the revenues generated from such ad valorem tax proceeds and the total budgetary requirement of the District was to have been funded by the General Fund in the amount of $67,690 or 56% of the total operating budget. The General Fund has funded this difference for each of the eight years since the District was established. However, the Mayor and City Commission directed the Administration to take the actions necessary to limit the General Fund contributions to 35% of the operating costs of the District as have previously been discussed by the Finance and Citywide Projects Committee, The Administration met with Normandy Shores Local Government Neighborhood Improvement District representatives on August 29th and they agreed with the Administration's recommendation to amend the enabling ordinance to eliminate the $500 cap on the highest valued home in the District and to amend the proposed millage from 0.801 mills to 1.194 mills. This millage will generate $78,000 which represents 65% of the operating budget of the District and will limit the contribution from the General Fund to $42,000 or 35% of the operating budget ANALYSIS The amended proposed ad valorem millage recommended by the Administration is 1.194 mills to provide the level of security required by this district. This tax levy will generate proceeds of $78,000 and the General Fund will fund $42,000 or 35% of the operating budget. On July 31, 2002, the City Commission adopted Resolution 2002-24942 which set the proposed operating millage rate for the District at 0.801 mills, To increase the proposed millage, the City must notify the Miami-Dade County Property Appraiser, who will prepare and distribute the required notification to each property owner in the District. Additionally, the City must revise the date of the first public hearing which can be no earlier than 10 days from the date of notice by the Miami-Dade County Property Appraiser. This notification is estimated by the Miami-Dade County Property Appraiser to cost approximately $1 ,000, which will be borne by the City. It must be noted that in accordance with State Statute, there is a 10 mill operating cap which cannot be exceeded without voter approval. Combining both millages from the dependent district (1.194) and the principal taxing authority (7.299) totals 8.493 mills, which is 1,507 mills less than the 10 mill cap. CONCLUSION The City Commission, acting in its capacity as the Board of Directors of the District, should adopt the attached Resolution which amends the proposed general operating millage and revises the date for the first public hearing.
