A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AMENDMENT NO. 2 TO THE AGREEMENT
BETWEEN THE CITY OF MIAMI BEACH AND GLATTING
JACKSON KERCHER ANGLIN LOPEZ RINEHART FOR THE
DESIGN OF WEST AVENUEIBAY ROAD NEIGHBORHOOD
IMPROVEMENTS INCREASING THE NOT TO EXCEED FEE
BY AN AMOUNT OF $19,980 TO PROVIDE FOR
ADDITIONAL DESIGN SERVICES FOR BAY ROAD
STORMWATER IMPROVEMENTS NECESSARY TO
SUPPORT RELATED STREETSCAPE IMPROVEMENTS
AND AUTHORIZING THE APPROPRIATION OF SAID
AMOUNT FROM THE SERIES 2000 STORMWATER
REVENUE BOND FUND.
WHEREAS On May 16, 2001, the Mayor and City Commission adopted Resolution
No. 2001-24388 authorizing the execution of a Professional Services agreement with the
firm of Glatting Jackson Kercher Anglin Lopez Rinehart, Inc., for Professional Landscape
Architectural and Engineering Services for the design of the West Avenue/Bay Road
Neighborhood Right of Way Improvement Project in the amount of $231 ,444; and
WHEREAS, On April 1 0, 2002, the Mayor and City Commission adopted Resolution
No. 2002-24821 authorizing the execution of Amendment Number One to the agreement to
provide for additional professional services associated with BaX Road drainage
improvements, streetscape and street end improvements to 10th, 14 , and 16th streets,
and a community planning meeting for a fee not to exceed $86,959; and
WHEREAS, The City had a need to complete the design of the improvements to
Bay Road between 14th and 16th Street ahead of the design of West Avenue
Neighborhood project as this component is required to be completed by the developer of
the adjacent Grand Flamingo project prior to its scheduled Fall 2002 opening; and
WHEREAS, After the approval of Amendment Number One to the agreement with
Glatting Jackson, staff and consultants proceeded with the development of improvement
plans based on the streetscape concept plan which was originally referenced in the DRB
approval order for the Grand Flamingo project and which received general community
support when presented at a November 8, 2001 Community Design Workshop; and
WHEREAS, the streetscape improvement concept plan was subsequently

substantially revised over the course of three public meetings in order to respond to
affected residents concems about the project; and
WHEREAS, the revisions to the streetscape design necessitated changes to the
partially completed design of related stormwater improvements resulting in the need for
additional services to complete the project design; and
WHEREAS, The City retained the services of Engineering Management Consultants
Pappas and Associates to negotiate the fees for the required additional services; and
WHEREAS, Pappas and Associates negotiated an Additional Services fee in the not
to exceed amount of $19,980 which they recommend as reasonable; and
WHEREAS, Funding in this amount is available from Series 2000 Stormwater
Revenue Bonds;
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that Amendment No. 2 of the City's
Agreement with Glatting Jackson Kercher Anglin Lopez Rinehart for the design of the West
Avenue/Bay Road Neighborhood Right of Way Improvement Project is hereby approved
and authorized by increasing the not to exceed fee by $19,980 to provide for additional
design services for Bay Road stormwater improvements necessary to support related
streetscape improvements and authorizing the appropriation of said amount from the
Series 2000 stormwater revenue bond funds.

Issue:
Should the City amend its agreement with Glatting Jackson Kercher Anglin Lopez Rinehart, Inc. for the
design of West Avenue Neighborhood Right Of Way Improvements by increasing the not to exceed fee by
an amount of $19,980 to provide for additional services required to modify the design of proposed Bay
Road stormwater improvements to address affected residents' concerns while still achieving the basic
streetscape improvement goals of the project, and, further, appropriate Series 2000 Stormwater Revenue
bond fundina in that amount?
Item Summa /Recommendation:
On May 16 , 2001, the City entered into an agreement with Glatting Jackson Kercher Anglin Lopez
Rinehart for the design of West Avenue Neighborhood Improvements. On November 8,2001, the City held
a West Avenue Community Design Workshop at which attendees expressed general support for the
improvements concept plan presented. The City had a need to expedite the design of the improvements to
Bay Road between 14th and 16th Street as this component is required to be completed by the developer of
the adjacent Grand Flamingo development prior to the opening of the project. Preliminary construction
drawings based on the previously presented concept plan were developed and notices of required right-of-
way reclamation sent to affected property owners. Affected residents unanimously opposed the plan, and
staff and the consultants developed a revised plan which addressed residents concerns while still meeting
the basic improvement objectives of the project. The revised plan required changes to the originally
contemplated stormwater improvements which resulted in the need for additional stormwater design
services. The City retained the services of Engineering Management Consultants Pappas and Associates
to negotiate the fees for the required additional services. Pappas and Associates negotiated with Glatting
Jackson and their stormwater sub-consultant Behar and Associates and agreed on a fee of $19,980 which
they recommend as reasonable in the attached memo. Funding for this amount is available from Series
2000 Stormwater Revenue Bonds. The Administration recommends the approval of the Amendment and
the a ro riation of $19,980 of Series 2000 Stormwater Revenue Bond funds for this ur ose.

originally referenced in the ORB approval order for the Grand Flamingo project and which
received general community support when presented at a November 8, 2001 Community
Design Workshop.
Preliminary construction drawings were developed and notices of required right-of-way
reclamation sent to affected property owners. Staff met with individual owners to explain
the plans and discuss ways of minimizing the impact of the work but encountered a large
degree of opposition to the overall plan as it required the reclamation of 10 feet of City
right-of-way on the east side of the 1400 and 1500 blocks of Bay Road. In recognition of
residents' sentiment, staff and consultant revised the plan so that only 5 feet of right-of-way
reclamation was required and presented the revised plan at a meeting on July 30, 2002 of
residents who still unanimously opposed the project.
At a second community meeting held on August 13, 2002 additional landscaping and other
changes were proposed to lessen the perceived project impact but residents still
overwhelmingly opposed the plan. At that time, it was agreed that the plan would be
further revised to eliminate all proposed parking on the east side of Bay Road so that no
reclamation of the City right-of-way would be required. Residents in attendance agreed to
this plan.
However, because this compromise required the elimination of 25 proposed new parking
spaces from the plan, staff and consultants revisited an earlier scheme to alternate bump-
out planter areas with parking on the east side of the street. This concept had been
previously considered and ruled out because the resulting stormwater improvement cost
would have been prohibitive. Upon further consideration, staff proposed the following
creative stormwater design variation which would allow this plan to be implemented in an
affordable manner.
In a typical road section, the pavement slopes down each side from the centerline high
point to the gutter at the curb. Water follows this route and then further travels a slight
downgrade at the curb line into a collection basin. The introduction of bump outs into this
typical section prevents the water from flowing along the curb line. To overcome this
obstacle, numerous additional collection basins must be installed at the curb line in
between the bump-outs which increases the cost of the work dramatically. Under the
design variation developed by staff, a continuous valley gutter runs along the edge of the
travel lane abutting the bump-outs. The collection basins are located in the valley gutter
rather than at the curb edge. The pavement from the centerline of the road slopes
downward to the valley gutter. The pavement from the edge of the road where the parking
spaces abut the curb slopes back inward towards the center of the street down to the
valley gutter. Through this design, no additional collection basins are required as the water
flows unimpeded along the length of the valley gutter. The cost of the additional valley
gutter required is minimal. The attached drawing (Attachment A) illustrates a typical block
based on this design.
This alternative plan was presented at a third community meeting held on August 26,2002
and was unanimously supported by the attendees.
The final revised plan required changes to the already partially completed design for
stormwater improvements which resulted in the need for additional stormwater design
services. The City retained the services of Engineering Management Consultants Pappas
and Associates to negotiate the fees for the required additional services. Glatting Jackson
initially proposed a fee of $35,448 for the additional services. Pappas and Associates
negotiated with Glatting Jackson and its stormwater sub-consultant Behar and Associates
and agreed on an additional services fee of $19,980 which they recommend as reasonable
in the attached memo (Attachment B). This represents a savings of $15,468, or
approximately 44%, from the initially proposed additional fee. Funding in this amount is
available from Series 2000 Stormwater Revenue Bonds.
It should be noted that this proposed contract Amendment No. 2 and associated fee
increase is not due to an addition to the scope of work of or funding for the project but
rather to a change in design from the original concept plan to a plan that was acceptable to
the directly affected property owners. Because of the need to expedite the design of these
two blocks to enable the Grand Flamingo to construct improvements as required by their
DRB approval order, design work had to proceed prior to the Commission adoption of the
neighborhood Basis of Design Report. Ideally, challenges to concept plans such as this
will be resolved prior to the initiation of design work.
The Administration recommends the approval of Amendment No.2 and the appropriation
of $19,980 of Series 2000 Stormwater Revenue Bond funds for this purpose.

DESCRIPTION OF WORK
GlattinQ Jackson is providing planning services and construction documents for
improvements to West Avenue Neighborhood, as outlined in the Agreement between the
City of Miami Beach and Glatting Jackson dated May 16, 2001. The City desires for
Glatting Jackson to provide these same services for revisions to Bay Road, including:
1. Planning services for streetscape/stormwater design of Bay Road
2. Streetscape/stormwater construction documents and design for Bay Road
Revisions to the 90% design submittal including but not limited to streetscape,
stormwater, roadway, pavement markings etc. is required to comply with the City's desire
to accommodate the neighborhoods request to limit the proposed improvements within an
approximate 50 foot +1- corridor.
DELIVERABLES
As a result of the work outlined above, Glatting Jackson shall provide:
. Six (6) sets of Bay Road Streetscape/Stormwater Construction Documents
SUBCONSUL TANTS
Glatting Jackson will serve as the Project Manager and Planner for this part of the project.
The project also requires the services of a Civil Engineer, who shall be a subconsultant to
Glatting Jackson. The Civil Engineer for this project is R.J. Behar & Company.
SCHEDULE
GlattinQ Jackson will begin work on this scope upon written authorization from the City of
Miami Beach, and will complete the above items by September 30, 2002.

Re: Negotiations on Bay I\1d tfuprovements/ Glatting Jackson
A meeting was held today with the prime AlE consultant, Glatting Jackson, their sub-
consultant Behar and Associates, City of Miami Beach staff, John dePazos, Hazen and
Sawyer Engineers Suresh Mistry and John Hoffinan, and Jim Pappas, of Pappas and
Associates.
Behar submitted a proposal in the amount of$35,448 to re-work their design as the right-
of way was cut back from 70 feet to 50 feet. After a 2 hours of a tough negotiation
session, I stated that the amount the City is willing to pay for the extra work was
$18,340. Behar said he could live with that number, but it did not include the $1887
amount for Gladding Jackson.. I said the bottom line was $18, 340 and if Glatting
Jackson and Behar wanted to lose a contract for $1887, then the City will start
negotiating with another firm. Sarah Wilkinson of Glatting Jackson had no authority to
negotiate something different than what Behar wanted. We tried twice to get a hold of
Richard Durr ofGlatting Jackson, but could not reach him.
Bottom line for the City is $18, 340. Glatting Jackson should get back to the City
tomorrow.
