A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA;
AUTHORIZING THE APPROPRIATION OF, $384,000 FROM
THE SERIES 2000 STORMW ATER BOND FUND 428; AND
AUTHORIZING THE AWARD IN THE AMOUNT OF $384,000
TO TRAN CONSTRUCTION, INC., PURSUANT TO BID NO.
61-01102 FOR THE CONSTRUCTION OF THE SUNSET
HARBOUR DRAINAGE STRUCTURES MODIFICATIONS.
WHEREAS, In 1996, the Sunset Harbour Streetscape Project was constructed,
which included a complete modification of the stormwater drainage system in the area
bounded by 20th Street, Purdy Avenue, Dade Blvd. and Alton Road, and
WHEREAS, subsequent to the construction of the Project and partly due to the
water quality level of service restrictions imposed by DERM, the stormwater drainage
improvements which were constructed did not resolve the stormwater drainage problems
which existed in the Sunset Harbour neighborhood; and
WHEREAS, during high tide events, especially when compounded by severe rain
events, severe flooding occurs; and
WHEREAS, in response to citizen complaints, design modifications were completed
for the existing drainage system on Sunset Harbour Drive and 20th Streets in order to
alleviate the flooding situation; and
WHEREAS, on August 6,2002, an Invitation to Bid No. 61-01/02 was issued. One-
thousand-two-hundred-ten (1,210) vendors were notified which resulted in forty (40)
requests for plans and specifications and four (4) bids received; and
WHEREAS, the Contractor's total base bid proposal for the construction of the
Project, as stipulated in the bid documents, is three hundred and eighty four thousand
dollars ($384,000), which is within the Project's construction budget; and
WHEREAS, The Administration and the City's Consultant, CH2M Hill, have
evaluated the bides) received, the bidders' references, and have determined that Tran
Construction, Inc. is the "lowest and best" bidder.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the City Manager or his designee to award a
contract to the "best and lowest bidder", Tran Construction, Inc., pursuant to Invitation to
Bid No. 61-01/02, for the construction of the Sunset Harbour Drainage Structures
Modifications; authorizing the Mayor and City Clerk to execute a contract, for an amount of
$384,000.00; and authorize the appropriation of such funds from the Series 2000
Stormwater Bond Fund 428.

not resolve the stormwater drainage problems which existed In the Sunset Harbour neighborhood. In fact,
during high tide events, especially when compounded by severe rain events, severe flooding occurs.
The bidder's proposal includes thefumlshing all labor, machinery, tools, means oftransportatlon, supplies,
equipment, materials, services necessary for the modification of drainage structures and piping systems at
three different locations. The Work will include the removal of existing control structures, and inlet and
outlet pipes; installation of new well boxes, control structures, catch basins, manholes, inlet and outlet
pipes; modification and development of existing drainage wells; pumping system at one location; relocation
of asphalt pathway; and restoration of roadway, curbs, gutters, and sidewalks Incidental to installation of
Project components. Additionally, the project requires restoration of all sod, landscaping, and irrigation
within the limits of construction.

In response to citizen complaints, the City issued Task Order No. 26 to the City's drainage
consultant, CH2M Hill, under an existing contract for a citywide Stormwater Management
Program, to design and permit proposed improvements to the existing drainage system on
Sunset Harbour Drive and 20th Streets in order to alleviate the flooding situation. The
design includes the modification of three existing drainage well structures by installing
appropriate pollution reduction boxes and modifying elevations of various pipes at the
following locations:, - ,- -
. In Island View Park at the intersection of Dade Boulevard and Purdy Avenue
(Sunset Harbour Drive)
. At the entrance to the Marina located at the intersection of Purdy Avenue and 18th
Street
. In the median strip at the intersection of 20th Street and West Avenue
The new structures will allow for overflow onto the existing outfalls, which are connected to
the existing drainage wells. The existing drainage wells, which have by this time become
clogged with debris, will be redeveloped. Additionally, pollution control boxeswiU be added
to the structures to prevent future clogging of the wells.
Under the original design, the proposed improvements included a one-year observation
period to ensure adequate function of the new drainage structures and the ability to retrofit
the new structures with a pumping system at a later date should the City determine that
pumping is required.
In meetings with the Sunset Harbour Task Force, the City agreed to fund at least one
pumping system at the entrance to the Marina located at the intersection of Purdy Avenue
(Sunset Harbour Drive) and 18th Street (the location which currently experiences the
greatest flooding problems).
On August 6,2002, Invitation to Bid No. 61-01/02 was issued. One-thousand-two-hundred-
ten (1,210) vendors were notified which resulted in forty (40) requests for plans and
specifications. A pre-bid conference was held on August 22, 2002, 10:00 AM at City Hall.
The Contractor's total base bid proposal for the construction of the Project as stipulated in
the bid documents is $384,000.
The bidder's proposal includes furnishing all labor, machinery, tools, means of
transportation, supplies, equipment, materials, services necessary for the modification of
drainage structures and piping systems at three different locations. The Work will include
the removal of existing control structures, and inlet and outlet pipes; installation of new well
boxes, control structures, catch basins, manholes, inlet and outlet pipes; modification and
development of existing drainage wells; pumping system at one location; relocation of
asphalt pathway; and restoration of roadway, curbs, gutters, and sidewalks incidental to
installation of Project components. Additionally, the project requires restoration of all sod,
landscaping, and irrigation within the limits of construction.

The work on the Sunset Harbour Drainage Structures Modifications is to be completed
under a single prime contract. Two (2) Notices to Proceed will be issued for this Contract.
CONTRACTOR shall commence scheduling activities, permit applications and other pre-
construction work within five (5) calendar days after the Project Initiation Date, which shall
be the same as the date of the first Notice to Proceed. The CONTRACTOR shall submit
all necessary documents required by this provision within twenty-one (21) calendar days of
the issuance of the first Notice to Proceed. The contract document stipulates that the
contractor shall attain substantial completion within one hundred-seventy (170) calendar
days after the date of issuance of the Second Notice to Proceed. Additionally, the project
must be completed and ready for final payment thirty (30) calendar days following the
substantial completion date.

References have been checked by Procurement staff and Dun and Bradstreet reports have
been secured for Tran Construction, Inc. and this Contractor is highly recommended. Tran
Construction, Inc. has been in business since 1998 as a General Contractor and is based
in the City of Miami Beach, and pursuant to the reference check, the information provided
indicates that Tran Construction, Inc. provides quality work, and completes jobs within the
required completion dates.
The Administration recommends the adoption of the Resolution by the Mayor and City
Commission, authorizing the negotiation of a contract with Tran Construction, Inc. for the
construction of the Sunset Harbour Drainage Structures Modifications.
