2002-3380 Ordinance ORDINANCE NO. 2002-3380 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NO. 93-2881, WHICH CREATED THE NORMANDY SHORES LOCAL GOVERNMENT NEIGHBORHOOD IMPROVEMENT DISTRICT ("DISTRICT"), BY AMENDING SECTION 4 THEREOF BY REMOVING THE $500 ANNUAL CAP PER PARCEL OF PROPERTY WITH REGARD TO THE LEVY OF AD VALOREM TAXES TO SUPPORT THE IMPLEMENTATION OF IMPROVEMENTS WITH REGARD TO THE DISTRICT; PROVIDING FOR REPEALER, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, on October 20, 1993, the Miami Beach City Commission adopted Ordinance' No. 93-2881 which authorized the creation of the Normandy Shores Local Government Neighborhood Improvement District, a Safe Neighborhood Improvement District, in accordance with Section 163.506 of the Florida Statutes; and WHEREAS, Ordinance No, 93-2881 also established the boundaries of the District; designated the Miami Beach City Commission as the Board of Directors of the District; provided authorization for the District to levy an ad valorem tax on real and personal property of up to 2 mills annually, but not to exceed $500 per parcel of property per year; provided authorization for the District to use special assessments pursuant to Section 163.514 of the Florida Statutes; and provided that the Mayor and City Commission may dissolve the District by rescinding the Ordinance creating the District; and WHEREAS, in order to meet the needs of District and to continue to provide the level of services and security as currently exist, it is necessary to amend Section 4 of Ordinance No. 93-2881 to remove the $500 annual cap per parcel of property in the District with regard to the levy of ad valorem taxes. NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA as follows: SECTION 1. That Section 4 of Ordinance No. 93-2881 is hereby amended as follows: Section 4: The District is hereby authorized to levy an ad valorem tax on real and personal property of up to two mills annually btrt ftot to exceed $500 per pftl'ee1 of pfOpmy per year, to support planning and implementation of District improvements. SECTION 2. REPEALER All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. SEVERABILITY If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 4. SECOND READING PUBLIC HEARING FROM: Pursuant to the request of Commissioner Jose Smith, and as recommended by the Administration, the above referenced Ordinance is submitted for consideration on second reading/public hearing by the Mayor and City Commission. This Ordinance is required in order to continue to provide the level of services and security as currently exist in the District while maintaining the City's contribution to the General Fund of 35% of the operating costs of the District. To this end, it is necessary to amend Section 4 of Ordinance No. 93-2881, which created the District, to remove the $500 annual cap per parcel of property in the District with regard to the levy of ad valorem taxes.
