2002-3381 Ordinance ORDINANCE NO. 2002-3381 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 78 ENTITLED "PERSONNEL" BY AMENDING ARTICLE II ENTITLED ''EMPLOYEES' BENEFIT PLAN" BY AMENDING DIVISION 3 THEREOF ENTITLED "CONTRIBUTIONS" BY AMENDING SECTION 78-81 THEREOF ENTITLED "GROUP HEALTH INSURANCE" AND SECTION 78-82 THEREOF ENTITLED "HEALTH MAINTENANCE ORGANIZATION (HMO)" BY PROVIDING THAT THE CITY'S CONTRIBUTION TO THE HEALTH PLAN FOR CITY OFFICERS AND EMPLOYEES SHALL BE DETERMINED BY THE AMOUNT OF FUNDS AVAILABLE EACH YEAR AND APPROVED BY THE CITY COMMISSION AS PART OF THE ANNUAL CITY BUDGET; PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, the City of Miami Beach amended the City's Related Special Acts, Section 27: City's Health Plan for City Officers and Employees, as the result of a Ballot Question on the November 6,2001 Special Election; and WHEREAS, the Ballot Question changed the City's contribution to the health plan for City Officers and Employees from one-half of benefit costs to a specific benefit to be established by Ordinance; and WHEREAS, the contribution shall be a specific amount as determined by the amount of funds available each year and approved by the City Commission as part of the annual City budget. NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AS FOLLOWS: SECTION 1. AMENDMENTS TO SECTION 78-81 OF THE CITY CODE. A. (2) The city shall continue to contribute at the same rate for members who are absent on authorized leave, sickness or military service and shall contribute at the same rate on behalf of retirants who elect to continue their agreements and pensioners who elect to become members of the plan. The board shall ascertain annually the total amount of contribution to be made by the city on behalf of members of this plan and shall certify such amount together with an estimate of administrative costs to the city manager for his review, recommendation and submission to the city commission for its approval and inclusion in the annual budget. REPEALER. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of the City of Miami Beach as amended; that the sections of the Ordinance may be renumbered or relettered to accomplish such intention; and that the word "ordinance" may be changed to "section" or other appropriate word. SECTION S. SEVERABILITY. If any section, subsection, clause, or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 6. EFFECTIVE DATE. ADMINISTRATION RECOMMENDATION Adopt the Ordinance. ANALYSIS The City amended the City of Miami Beach's Related Special Acts, Section 27: City's Health Plan for City Officers and Employees, as a result of the Ballot Question on the November 6,2001 Special Election. This changed the City's contribution to the Health Plan from one-half of benefit costs to a specific benefit to be established by Ordinance. For Fiscal Year 2002-2003 the City experience a 28% increase in health insurance costs. In an effort to reduce the financial impact on the employees, the City is offering two additional medical plans to the existing program. The new HMO and PPO options offer somewhat lower benefit levels while still providing a comprehensive plan at a lower cost than the existing plans. In addition, the City will pay 65% of the employee cost for individual coverage under these new plans. The new plans and cost sharing increase are consistent with recommendations made by the Group Insurance Task Force. The Task Force was a group of employees, businesses and residents that I tasked with a review and analysis of our health plans in an effort to help make improvements. Funds for these changes are fully incorporated into the proposed 2002-2003 budget. The City offered these two new plans to all City employees except Police and Fire who have a separate health trust. The Communication Workers of America (C.W.A) and the Miami Beach Municipal Employees (AF.S.C.M.E.) have elected not to participate at this time. Unclassified employees, the Government Supervisors Association (G.S.A) and the group "Others" will be participating in the new plans. (See Attachment A, letter from A.F.S.C.M.E.; we have not yet received a letter from C.W.A). We will be able to make adjustments to the contributions made by the City, within the confines of the approved annual budgets, and positively impact recruitment and retention of employees while aligning the City with contributions made by other government employers and nationwide trends.
