RESOLUTION NO. 2002-25035
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE MAYOR AND
CITY COMMISSION TO GRANT THE ATTACHED NON-EXCLUSIVE
EASEMENT TO FLORIDA POWER & LIGHT COMPANY (FP&L) FOR
THE PROVISION OF UNDERGROUND DISTRIBUTION FACILITIES AND
A TRANSFORMER PAD AT THE NORTH SHORE PARK AND YOUTH
CENTER; AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AND RECORD THE EASEMENT FOR THE REQUIRED
UNDERGROUND FACILITIES AND TRANSFORMER PAD.
WHEREAS, the City owns the North Shore Park and Youth Center (Property); and
WHEREAS, as part of the City's Parks and Recreation General Obligation Bond Parks Master
Plan, the City initiated the improvements to the North Shore Park and Youth Center; and
WHEREAS, On September 10,2001, the City issued an Invitation to Bid for the construction of
the North Shore Park and Youth Center and the contract was awarded to The Collage Design and
Construction Group; and
WHEREAS, to allow for an early occupancy by the public, the Project was divided into three (3)
phases; and
WHEREAS, Phase I, consisting of baseball fields with a concession field house, tot lot and
basketball court, started in March 2002, and has been proceeding on schedule with an anticipated
substantial completion date of November 2002; and
WHEREAS, in order to supply the electrical power to the Property, Florida Power and Light
(FP&L) has installed a transformer on a pad with underground feeders at the Property; and
WHEREAS, to energize the system, FP&L is requesting the City to grant the attached easement
for the pad mount transformer and the underground transmission ducts area.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein approve the grant of the attached Non-Exclusive Easement to Florida Power & Light
Company (FP&L) for the provision of underground distribution facilities and a transformer pad to the
North Shore Park and Youth Center and authorize the Mayor and City Clerk to execute and record the
Easement for the required underground facilities and transformer pa

A resolution authorizing the Mayor and City Commission to grant an easement to Florida Power & Light
Company (FP&L) for the provision of underground distribution facilities and a transformer vault at the North
Shore Park and Youth Center Project.
Issue:
Shall the City Commission grant an easement to FP&L at the North Shore Park and Youth Center?
Item Summary/Recommendation:
In 2001, the City approved the reconstruction of the North Shore Park and Youth Center. The construction
of these improvements was to be completed in 3 phases. In order to supply the electrical power to the
reconstructed facilities, FP&L has installed a new transformer with underground transmission lines. Since
Phase I will be completed in November 2002 and FP&L needs to energize the system, they require an
easement to ensure long-term access to their improvements.

BACKGROUND
On September 10, 2001, the City issued an Invitation to Bid for the construction of the
North Shore Park and Youth Center (NSPYC). Bids were opened on October 10, 2001
and the contract was awarded to The Collage Design and Construction Group, Inc., d.b.a.
"The Collage Companies", as the established "lowest and best" bidder.
To allow an early occupancy by the public, the project was divided into three (3) phases,
each one with a different substantial completion date. They were as follows:
1. Phase I: Baseball fields with alternatives to construct a concession field house, tot lot
and basketball court,
2. Phase II: Tennis center, tennis courts, shuffle board courts, practice court,
maintenance building, with an alternative to construct pavilions.
3. Phase III: Community center, gymnasium and entry plaza.
The construction of Phase I of this project started in March 2002 and has been proceeding
on schedule with an anticipated substantial completion date of November 2002.
In order to supply the electrical power to the new facilities, Florida Power and Light (FP&L)
has installed a transformer on a pad with underground feeders in this park property. To
energize the system, FP&L is requesting the City to grant an easement for the pad mount
transformer and the underground transmission ducts area.
ANALYSIS
Public Works has reviewed existing City records, found no conflict with existing
underground utilities or land use and, therefore, recommends granting a non-exclusive
easement. The non-exclusive easement will be granted to FP&L for the installation and
maintenance of an underground transmission system and for the transformer pad area,
within that portion of as shown in the attached legal description and sketch. The easement
will be valid for the duration of said structure and facilities being in service and will revert to
the City in case of removal of such electrical services.
CONCLUSION
The Administration recommends the granting of the easement by the Mayor and City
Commission to Florida Power & Light for the underground utilities and the transformer pad,
and the execution and recording of said easement by the Mayor and City Clerk to allow
energizing of the North Shore Park and Youth Center.
