A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, APPROVING THE FIRST OF THREE, ONE (1)
YEAR RENEWAL TERMS WITH BEACH TOWING
SERVICES, INC. AND TREMONT TOWING SERVICES,
INC., RESPECTIVELY; BOTH TERMS COMMENCING ON
DECEMBER 1, 2002, AND EXPIRING ON NOVEMBER 30,
2003, WITH OPTIONS TO RENEW FOR TWO (2)
ADDITIONAL ONE (1) YEAR TERMS, AT THE SOLE
DISCRETION OF THE CITY; FURTHER APPROVING THE
TWELFTH AMENDMENT TO THE ADMINISTRATIVE
RULES AND REGULATIONS FOR THE POLICE
DEPARTMENT AND PARKING DEPARTMENT TOWING
PERMITS; SAID AMENDMENT PROVIDING FOR AN
INCREASE TO THE MAXIMUM ALLOWABLE TOWING
RATES,
WHEREAS, Chapter 106, Article V of the Miami Beach City Code, provides for
police vehicle towing permits for the towing of vehicles identified by the City as requiring
removal from public and private property; and
WHEREAS, the City issued Request for Proposals No. 1-91/94 for Providing
Police and Parking Department Towing Services in the City of Miami Beach, and
thereafter the Mayor and City Commission selected Beach Towing Service, Inc. and
Tremont Towing Service, Inc. as the successful proposers to provide these services;
and
WHEREAS, pursuant to Resolution No. 95-21615, the Mayor and City
Commission extended the towing permits issued for Beach Towing Service, Inc. and
Tremont Towing Service, Inc. for a fifteen (15) month period that commenced on July 1,
1995 and expired on September 30, 19~6; and
WHEREAS, on June 21, 1996, the Mayor and City Commission approved a
second extension of the permit for a period of sixty (60) days, from September 30, 1996
to November 30, 1996, to negotiate additional terms and conditions of the towing
permits with Beach Towing Service, Inc. and Tremont Towing Service, Inc.; and
WHEREAS, on November 20, 1996, the Mayor and Commission approved an
extension of the towing permits for a period of two (2) years, expiring on November 30,
1998, with a one (1) year option, to be renewed at the sole discretion of the City; and
WHEREAS, on November 18, 1998, the Mayor and Commission approved the
two one-year renewal options of the towing permits, expiring on November 30, 1999
and 2000, respectively; and
WHEREAS, on October 18, 2000, the Mayor and Commission waived, by a 5/7th
vote, the competitive bidding requirement and approved a two-year towing permit,
expiring on November 30, 2002, with three additional one-year terms, to be renewed at
the sole discretion of the City; and
WHEREAS, Beach Towing and Tremont Towing continue to be the only two
service providers which satisfy all requirements as stipulated in the City's towing permit
requirements, including the ability to provide storage facilities within the City limits; and
WHEREAS, the Administration, including the Police Department and the Parking
Department, are satisfied with the level of service provided by both Beach Towing
Services, Inc. and Tremont Towing Services, Inc., and herein recommend exercising
the first of the three one (1) year renewal terms, commencing on December 1, 2002,
and expiring on November 30, 2003; and
WHEREAS, the Administration has also reviewed the maximum allowable towing
rates, as outlined in the Eleventh Amendment to the Rules and Regulations for the
Police Department and Parking Department Towing Permits, and herein recommends,
as the Twelfth Amendment to the Rules and Regulations for increasing the existing
maximum allowable towing rate for Class "A" tows from $90.00, to $95.00; and
increasing the City's administrative fee per tow (fee paid to the City by towing service
provider) from $20.00, to $25.00; and from $10.00, to $12.50, for each vehicle which is
disconnected from the towing or removal apparatus; and
WHEREAS, the Administration further recommends that the effective date of this
Twelfth Amendment be November 1, 2002, and the effective date of the renewal term
of the towing services provided by Beach Towing Service, Inc. and Tremont Towing
Service, Inc. be December 1,2002, if approved; and
WHEREAS, the Transportation and Parking Committee reviewed and discussed
these recommendations at its October 7,2002 Meeting and endorsed same.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission,
upon recommendation of the Administration, approve the first of three one-year renewal
option terms with Beach Towing Services, Inc. and Tremont Towing Service, Inc., both
commencing on December 1, 2002, and expiring on November 30, 2003; further
approving the Twelfth Amendment to the Rules and Regulations for the Police
Department and Parking Department Towing Permits increasing the existing maximum
allowable towing rate for Class "Au tows from $90.00, to $95.00; and increasing the
City's administrative fee per tow (fee paid to the City by towing service provider) from
$20.00, to $25.00; and from $10.00, to $12.50 for each vehicle which is disconnected
from the towing or removal apparatus; and the Twelfth Amendment having an effective
date of November 1, 2002 for the increase to the maximum allowable rates.
Accordingly, the Mayor and City Clerk are herein authorized to execute any and all
documents memorializing this extension.

Issue:
Whether to approve a one-year renewal term to both Beach Towing and Tremont Towing commencing on
December 1,2002 and expiring on November 30,2003 and an increase to the maximum allowable towing
rate from $90.00 to $95.00, of which the City's administrative fee per tow would increase from $20.00 to
$25.00 and from $10.00 to $12.50 for each vehicle which is disconnected from the towing or removal
apparatus (drop fee), and establish a $35 per job fee for dolly or flatbed use required by the manufacturer's
specifications, effective November 1, 2002.
Item Summary/Recommendation:
The Police Department and the Parking Department have been satisfied with the level of service provided
by both Beach Towing Services, Inc. and Tremont Towing Services, Inc. Moreover, both service providers
are the only qualified towing service providers. The Administration recommends exercising the first of
three one (1) year renewal options, commencing on December 1, 2002 and expiring on November 30,
2003 and recommends an increase to the maximum allowable towing rates, including an increase to the
maximum allowable towing rate for Class "A" tows from $90.00 to $95.00 and increase the City's
administrative fee per tow fee (City's portion) from $20.00 to $25.00 and from $10.00 to $12.50 for each
vehicle which is disconnected from the towing or removal apparatus (drop fee), effective November 1,
2002. Effectively, the $5.00 increase to the Class "P\' tow rate will be passed on to the City by increasing
the administrative per tow fee (City's portion) by $5.00. Also, the current Rules and Regulations Permit
(Amendment No. 11) does not provide for the use of a dolly or flatbed as may be required by the vehicle's
manufacturer; therefore, a $35 per job fee for dolly or flatbed use as may be required by the vehicle
manufacturer's specifications is recommended. Said amendments are to be effective November 1,2002.
Fiscal impact of the proposed fee increase annually is $25,000 to the Parking Enterprise Fund and $23,000
to the Police Department.
THE ADMINISTRATION RECOMMENDS THE ADOPTION OF THE RESOLUTION.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS:
The towing service providers Tremont Towing located at 1916 Bay Road, Miami Beach,
Florida and Beach Towing, located at 1349 Dade Boulevard, Miami Beach, Florida,
currently have a permit issued by the City to provide towing service to the Police and
Parking Departments. On November 20, 1996, the Mayor and City Commission waived by
a 5/7ths vote, the competitive bidding requirement, and approved an extension of the
towing permits for a period of two years, to expire on November 30, 1998. On November
18, 1998, the Mayor and City Commission approved two (2) additional one (1) year
options, to be renewed at the sole discretion of the City. The second one (1) year option
will expire on November 30, 2000. On October 18, 2000, the Mayor and City Commission
waived, by a 5/7ths vote, the competitive bidding requirement, and approved a two (2) year
contract, with three (3) one-year options, to be renewed at the sole discretion of the City.
The Administration, including the Police Department and the Parking Department are
satisfied with the level of service provided by both Beach Towing Services, Inc. and
Tremont Towing Services, Inc, Moreover, both services providers are the only qualified
towing service providers satisfying the minimum vehicle storage requirements (capacity for
storage of 100 vehicles) within the city limits.

The Administration, including the Police and Parking Departments recommend exercising
the first of three one (1) year renewal options, commencing on December 1, 2002 and
expiring on November 30, 2003.
Furthermore, the Administration has reviewed the maximum allowable towing rates as
outlined in the Eleventh Amendment of the Rules and Regulations for the Police
Department and Parking Department Towing Permits and recommend the following
amendments:
Section 21,2 Maximum Allowable Rates
. Increase the existing maximum allowable towing rate for Class "A" tows from $90.00 to
$95.00.
. Establish a $35.00 maximum fee for the use of dollies or flatbed services as required by
the vehicle manufacturer's specifications:
Section 34 Permit Fee - Monthly Billing
· Increase the City's administrative fee per tow from $20.00 to $25.00 and from
$10.00 to $12.50 for each vehicle, which is disconnected from the towing or removal
apparatus.
The Administration recommends the aforementioned amendments to be effective on
November 1, 2002. Furthermore, the TPC (Transportation and Parking Committee)
reviewed and discussed this recommendation at the October 7,2002 Meeting. The TPC
endorses this recommendation.
For informational purposes, on November 18, 1998, the Mayor and Commission approved
an increase to the maximum allowable rates by increasing the administrative fee from $15
to $30. To their credit, neither Beach Towing Services nor Tremont Towing Services had
instituted the aforementioned fee increase in the last four years. However, effective
November 1, 2002, both Beach and Tremont will be increasing the aforementioned
administrative fee from $15 to $20.
The Administration recommends that the Mayor and City Commission approve the
exercising of the first of three one (1) year renewal options, commencing on December 1,
2002 and expiring on November 30, 2003; further approving an increase to the maximum
allowable towing rates as outlined in the proposed Twelfth Amendment of the Rules and
Regulations for the Police Department and Parking Department Towing Permits. Said
amendments are: (1) increase maximum allowable towing rate for Class "A" tows from
$90,00 to $95.00 and (2) increase the City's administrative fee per tow from $20,00 to
$25.00 and from $10.00 to $12.50 for each vehicle which is disconnected from the towing
or removal apparatus (drop fee), and (3) establish a $35 per job fee for dolly or flatbed use
required by the vehicle manufacturer's specifications, effective November 1, 2002.
