A RESOLUTION AUTHORIZING EXECUTION OF
AGREEMENT WITH THE STATE OF FLORIDA TO
PROVIDE A GRANT FOR PHASE I DEVELOPMENT
Or NORTH SHORE OCEANFRONT PARK.
WHEREAS, the City of Miami Beach proposed development
of approximately fifty-five (55) acres located on Collins Avenue
extending from 79th to 87th Street, and
WHEREAS, the United States Department of Interior, Bureau
of Outdoor Recreation, has approved the application made by the
State of Florida on behalf of the City of Miami Beach for Phase I
development of North Shore Oceanfront Park (Land and Water Conser-
vation Fund Project No. 12-00090) , and
WHEREAS, the State of Florida will tender to the City of
Miami Beach Three Hundred Thirty-one Thousand One Hundred Forty-
seven Dollars ($331, 147.00) representing fifty percent (50%) of
the estimated cost of Phase I upon execution of an agreement between
the City of Miami Beach and the State of Florida, and
WHEREAS, an appropriate agreement with the State of
Florida has been prepared and has been approved as to form by the
City Attorney providing for the terms and conditions upon which
financial assistance will be rendered, a copy of which is attached
hereto and made a part hereof, and -
WHEREAS, the City Manager has recommended to the City
Council that said Agreement be executed, and
WHEREAS, the City Council of the City of Miami Beach
deems it to be in the best interest of the City and its residents
to enter into said Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk be and they are hereby authorized and directed to execute
and deliver the said Agreement for and in the name of the City
of Miami Beach.

Project Scope (Description of Project)
Project proposes Phase I development of 55-acre city-owned c'
tract located on Collins Avenue extending eastward to the - '
Atlantic -Ocean from 79th V{ad 87th Street. Construction
will include boardwalks, lifeguard stations, shade pavilions
and comfort stations, retaining wall and benches with
necessary support facilities. Preagreement costs incurred
from 12-6-72 to date of project approval, in amount not to
exceed $16, 500.00, shall be allowable under this agreement.
Excluded from within subject site are five parcels of land
now under condemnation proceedings. Phase I development
will not permit parking within confines of park.
Operation and maintenance will be handled by City of Miami
Beach.

hereinafter referred to as the City
mutually agree to perform this agreement in accordance with the Land
and Water Conservation Fund Act of 1965, 78 Stat. 897 (1964) as
amended (1968) and with the terms, promises, conditions, plans,
specifications, estimates, project proposals, maps, and assurances
attached hereto and hereby made a part hereof.
The State hereby promises, in consideration of the promises
made by the City herein, to obligate to the
City the amount of money referred to
above, and to tender to the City that portion of
the obligation which is required to pay the United States ' share
of the costs of the above project stage, based upon the above
percentage of assistance. The City
hereby promises, in consideration of the promises made by the
State herein, to execute the project or project stage described
above in accordance with the terms of this agreement.
The following special project terms and conditions were added
to this agreement before it was signed by the parties hereto:
The State of Florida shall transfer to
City of Miami Beach all funds granted
hereunder.
This agreement is not subject to the provisions
of Section B. 2 (d) of the attached General Pro-
visions dated December, 1965.
If, for anythis
reason, project fails to be
completed by December 31, 1975, the State of
Florida reserves the right to deobligate its
total financial commitment of $331, 147.00,
or any portion thereof, to City of Miami Beach,
on behalf of the United States in order to
prevent the State of Florida from forfeiting
this part of its Fiscal Year 1974 apportionment.
In witness whereof, the parties hereto have executed this
