A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA AUTHORIZING THE MAYOR, OR ms DESIGNEE, TO
ENTER INTO AN AGREEMENT WITH THE NATIONAL CENTER FOR MISSING
AND EXPLOITED CmLDREN (NCMEC) TO RECEIVE COMPUTER HARDWARE,
SOFTWARE, AND SUPPORT SERVICES AT NO COST TO THE CITY; PROVIDED
UNDER A UNITED STATES DEPARTMENT OF JUSTICE, OFFICE OF JUVENILE
JUSTICE AND DELINQUENCY PREVENTION COOPERATIVE AGREEMENT NO.
98-MC-CX-K002.
WHEREAS, the City of Miami Beach wishes to enter into an agreement with the
National Center for Missing and Exploited Children to receive computer hardware, software, and
support services at no cost to the City; and
WHEREAS, the attached Agreement outlines the terms and conditions under which the
NCMEC will provide the computer equipment to the City under a United States Department of
Justice Cooperative Agreement; and
WHEREAS, title to any computer equipment provided under this Agreement will vest
solely in the City.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor or his
designee are authorized to enter into an agreement with the National Center for Missing and
Exploited Children (NCMEC) to receive computer hardware, software, and support services at no
cost to the city; provided under a United States Department of Justice, Office of Juvenile Justice
and Delinquency Prevention Cooperative Agreement No. 98-MC-CX-K002.

Item Summa IRecommendation:
The Administration recommends the adoption of this resolution that will allow for the Police Department to
receive this technology under the auspices of the National Center for Missing and Exploited Children. The
National Center for Missing and Exploited Children (NCMEC) has developed the Lost Child Alert
Technology Resource (LOCA TER) which provides the technology to aid in the search for these children.
Through a Congressional mandate and United States Department of Justice Grant, the LOCA TER program
provides all hardware, software, and dial-up access at no charge to law enforcement agencies responsible

Adopt the Resolution.
ANALYSIS
The National Crime Information Center (NCIC) data shows that on average 2,100 missing
children are entered in the system everyday. The National Center for Missing and
Exploited Children (NCMEC) has developed the Lost Child Alert Technology Resource
(LOCATER) which provides the technology to aid in the search for these children.
LOCA TER is an advanced computer system with software that creates posters of missing
children for local, statewide, or nationwide distribution. LOCATER uses e-mail, fax, and
print functions to notify law enforcement, media, and the public of missing child cases.
LOCA TER also speeds the creation of missing child posters as well as templates to create
other posters such as wanted, reward, property, vehicle, crime alerts, and lineups.
Through a Congressional mandate and United States Department of Justice Grant, the
LOCA TER program provides all hardware, software, and dial-up access at no charge to
law enforcement agencies responsible for investigating missing children cases.
Specifically, the grant provides one Dell business computer, Hewlett-Packard scanner and
printer, Earthlink dial-up access, Microsoft Office Small Business Edition, Dell's 3-year
onsite support with lifetime 24 hour technical telephone support, Hewlett-Packard's 3-year
warranty on printers and scanners, and a computer desk. Ownership and title to the
equipment is transferred to the City upon acceptance and installation. The City of Miami
Beach Police Department will be responsible for office supplies such as paper and printer
ink cartridges.
CONCLUSION
It is recommended that the Mayor and City Commission adopt this Resolution and
authorize entering into the Agreement that will allow the Police Department to receive this
technology under the auspices of the NCMEC.

NCMEC agrees to the followiug:
1. Provide your agency with computer hardware, software, and support services listed in attachment
A, free of charge. NCMEC will transfer title to your agency upon acceptance and installation.
2. Provide written documentation to setup and operate the LOCATER system. On-site training is not
available.
3. Provide ongoing technical assistance on the use of the system. NCMEC may make use of an
outside vendor to provide such technical assistance.
4. Provide software upgrades free of charge.
Your agency agrees to the following:
I. Comply with all reasonable requests from other law-enforcement agencies, as well as NCMEC, to
aid in the search and recovery of missing children. (i.e. assisting non-participating agencies create
or distribute missing child posters)
2. Your agency is responsible for supplying all expendable items (office supplies) such as diskettes,
printer paper and ink cartridges.
3. LOCATER requires an Internet connection to send or receive posters to other agencies. This can
be via a dial-up connection, or through an existing network. If your agency chooses a dial-up
connection, your agency must provide a dedicated analog telephone line at your expense.
4. If your agency elects to use LOCATER to send posters to facsimile machines through the optional
broadcast fax service arranged by NCMEC (Xpedite Corporation), your agency will be responsible
for the cost of sending facsimiles, currently 25 cents per poster.
5. NCMEC cannot support self-installed hardware or software.

General. This information is provided pursuant to Public Law 93-579 (Privacy Act of 1974) for individuals
completing LEO user application forms. Authority. LEO is a federally funded national communications
system established by the FBI. Application information is solicited under the authority of the Federal
Records Act (Title 44, United States Code) and implementing regulations (Title 36, Code of Federal
Regulations, chapter XII). Purpose and Use - The principal purposes of LEO user application forms are
to collect personal information needed to determine if you qualify as an authorized user, collect your
computer hardware and operating system (OS) configuration information needed to determine user
configuration requirements. and verify your identity as an authorized LEO user. Completed applications
will be used to register you as a qualified LEO user and to arrange for access to LEO. All or part of your
,completed LEO user application form may be disclosed outside the FBI to federal, state, local, or tribal law
enforcement agencies charged with the responsibility of investigating a violation or potential violation of the
law and to your agency or organization to periodically verify that you continue to qualify for access to LEO.
Disclosure may otherwise be made pursuant to the routine uses most recently published in the Federal
Reaister for the FBI's Central Records System (Justice/FBI 002). Effects of Non-disclosure. It is in your
best interest to answer all questions. However, disclosure of requested personal information, including
social security number, is voluntar.y. Failure to provide the requested information may result in the denial
of your application.
