A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH AUTHORIZING EXECUTION
OF AGREEMENT FOR PURCHASE OF PROPERTY,
TO WIT , LOTS 1 THROUGH 9 , BLOCK 15, ISLAND
VIEW SUBDIVISION, AND A PARCEL OF
SOVEREIGNTY LAND IN BISCAYNE BAY ABUTTING
SECTION 33 , TOWNSHIP 51 SOUTH, RANGE 42
EAST, DADE COUNTY, FLORIDA.
WHEREAS , the City Council of the City of Miami Beach,
Florida, deems it to be necessary for the welfare of said City
and the inhabitants thereof to acquire for appropriate municipal
uses the following described property, situate, lying and being
in the City of Miami Beach, Dade County, Florida, to wit:
Lots 1 , 2 , 3, 4, 5 , 6 , 7 , 8 and 9 , in Block
15, ISLAND VIEW SUBDIVISION, according to
the Plat thereof, recorded in Plat Book 6,
Page 115 , of the Public Records of Dade
County, Florida;
AND
A parcel of sovereignty land in Biscayne Bay
abutting Section 33 , Township 5-1 South, Range
42 East, Dade County, Florida; more particularly
described in that certain Deed No . 25150
(2329-13) dated October 9 , 1970, between State
of Florida Board of Trustees of the Internal
Improvement Trust Fund and H. P . Forrest, as
Trustee, under that certain Land Trust
Agreement dated April 30,1966, said Deed
being recorded in Official Records Book 7001 ,
Page 228 , of the Public Records of Dade
County, Florida, and all littoral or riparian
rights which may exist as to the subject
properties ;
and
WHEREAS, an appropriate agreement has been prepared,
and attached hereto and made a part hereof, the terms of which
are familiar to the City Council of the City of Miami Beach;
and
WHEREAS , the City Manager of the City of Miami Beach
has recommended the approval and execution of said agreement for
the purchase of the property hereinabove described, and the
City Attorney has approved the same as to form and legality; and
WHEREAS , the City Council of the City of Miami Beach
deems it to be in the best interests of the City of Miami Beach
and its inhabitants that said agreement be agreed to, entered into
and executed.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that it hereby accepts and
approves the recommendation of the City Manager to purchase the
property hereinabove described for the purpose hereinabove

mentioned, for the total existing indebtedness on said property
not to exceed Six Hundred Twenty-four Thousand and no/100
Dollars ($624 , 000 . 00) , as set forth in the said agreement.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute said
agreement in the name of and on behalf of the City of Miami
Beach, and the proper financial officers of the City be and they
are hereby authorized and directed to disburse the monies
required by the terms of said agreement from the funds of the
City available for such purpose.

1971, filed April 16 , 1971, under Clerk' s File No. 71R-70916,
in the Public Records of Dade County, Florida, the present
balance of which in the approximate sum of FOUR HUNDRED EIGHTY
NINE THOUSAND THREE HUNDRED TWENTY ONE AND 60/100 DOLLARS ($489 , 321. 60
the Grantee herein agrees to assume and pay. This is a mortgage
securing an open end note which will not exceed the sum of
FIVE HUNDRED TWENTY TWO THOUSAND EIGHT HUNDRED AND 07/100 DOLLARS
($522 , 800. 07) .
5. . The subject property is to be used exclusively for
r public purposes- as defined by Section 170 of the Internal Revenue

The Grantor herein is duly authorized to execute this
Deed as Trustee and to bind the beneficiaries of the unrecorded
Land Trust Agreement dated April 30, 1966 and under any
amendments thereto.
TO HAVE AND TO HOLD the same together with all and
singular the appurtenances thereunto belonging or in anywise
appertaining, and all the estate, right, title, interest and
claim whatsoever of the Grantor herein, either in law or equity,
to the only proper use, benefit and behoof of the Grantee herein,
heirs,.and assigns forever.
IN WITNESS WHEREOF, the Grantor has hereunto set his
hand and seal this 27th day of December, 1974.
