A RESOLUTION OF THE CITY COMMISSION OF MIAMI
BEACH, FLORIDA, AUTHORIZING THE ABANDONMENT OF
A CITY UTILITY EASEMENT AND VACATING SAME CONDI-
TIONED UPON THE RELOCATION OF CERTAIN UTILITIES
AT THE GRANTEES ' EXPENSE; AUTHORIZING THE EXE-
CUTION OF A QUIT CLAIM DEED EVIDENCING SUCH
VACATION AND ACCEPTING AN ALTERNATIVE UTILITY
EASEMENT. (PROPERTY LOCATED AT REAR OF THE
NORTH 25 FEET OF LOTS 7 AND 14 AND ALL OF LOTS 8
THRU 13 , BLOCK 41, BELLEVIEW SUBDIVISION, PLAT
BOOK 6 , PAGE 114 , 1681 Bay Road, 1676-90 West
Avenue. )
WHEREAS, the owners of the real property described in the
attached Exhibit "A" , have petitioned the City Commission of the
City of Miami Beach to vacate said utility easement; and
WHEREAS, said easement has been abandoned by the public;
and
WHEREAS, the vacation of the subject easement is deemed to
be in the best interest of the City of Miami Beach and its citizens
provided that the grantee of said vacated easement relocate, at
their expense, the utilities in said easement and that said grantee
dedicate to the City an alternative easement as required by the
Public Works Department; and
WHEREAS, the Public Works Department recommends that the
City vacate the aforementioned easement and accept an alternative
easement; and
WHEREAS, the said owners and parties of interest agree
that they will pay the full cost of abandoning portions of the
existing water main and constructing a new water main in West Avenue
estimated to cost $8 ,000 .00 ,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City surrenders all
its right, title and interest to the property described in the
attached Exhibit "A" and authorizes the execution of a Quit Claim
Deed evidencing same conditioned upon the relocation of the utili-
ties in said easement by the Grantees of the Quit Claim Deed and
accepting an alternative easement dedication as required by the
Public Works Department of the City of Miami Beach.

SUBJECT: Request for Abandonment of an Existing Easement at the Rear of
the North 25 Feet of Lots 7 and 14 and all of Lots 8 thru 13,
Block 41, Belleview Subdivision, Plat Book 6, Page 114.
The owners of the above property have requested that the easements
be abandoned to allow for construction of a new building. The
existing easements are utilized by the various utilities companies
and the owner has agreed to satisfy the requirements of these
utilities. Florida Power and Light, Southern Bell, Peoples Gas
and Ultra-Com of Dade County, Inc. have no objections to the
abandonment of the easements and have set forth their requirements
as outlined in the attached letters, to which the owner has agreed.
The Public Works Department has reviewed the request and has no
objections to the abandonment, provided the owner pays for the
construction of a new water main in West Avenue estimated to cost
$8,000. , and dedicates the south five feet of Lot 6 and the south
five feet of the north 25 feet of Lot 14 as a utility easement,
to which the owner has agreed.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the existing easements be
abandoned and in exchange the owner dedicates utility easements and
pays all costs for utilities relocated, and construction of a
water main as indicated on the attached sketch. Also, that the
$8,000. deposited, be appropriated for constructing the water main.

Dear Mr. Toal:
Peoples Gas System, Inc. has abandoned all gas mains on the referenced ease-
ment; therefore, we have no objedtions reverting said easement to Isaac Sklar
Associates/Architects, Inc.
Our existing gas mains surrounding that property gives us adequate
possibilities for natural gas service if they so require.

Dear M . Sklar:
This letter is to advise you that UltraCom agrees to abandon the
easement on lots 6, 7, 8, 9, 10, 12, 13 and one-half of lot 14.
We do ask that access to the buildings to be constructed on these
lots be provided by reams of two inch conduit with sweep elbows
from our present distribution plant on two utility poles located
between lots 5 and 6. Also, if Bay Drive requires excavation, we
request that conduit be provided that might be used to tie in our
plant on the poles located on the West side of Bay Drive.
