A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY
MANAGER TO RETURN ALL FEES COLLECTED FOR TAXI-
CAB PERMITS AFTER OCTOBER 15 , 1981.
WHEREAS, the City Commission, on October 15 , 1981,
recommended that the Taxicab Bureau stop collecting fees for taxi-
cab permits; and
WHEREAS, the City Manager recommends that all fees
collected after October 15 , 1981 be returned to the respective
applicants;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that the City Manager be hereby
authorized and directed to return to all applicants, fees for taxi-
cab permits paid after October 15 , 1981.

SUBJECT: TAXICAB PERMIT AND LICENSE REFUNDS.
On October 15, 1981, the City Commission voted to extend from October 31, 1981, to
January 31, 1982, all City taxicab permits with no further payment of fees.
The reasoning behind this decision was that on October 1, 1981, the Circuit Court
invalidated the City of Miami Beach's Taxicab Ordinance and upheld the Dade County
Taxicab Ordinance. On October 2, 1981, the Circuit Court granted to the City of Miami
Beach a stay which then meant that the City's recently invalidated Taxicab Ordinance was
still in effect. Owing to this confusion the City Commission instructed the City Attorney to
file an appeal, but recognized that an extension of the 1981 permits should be given to
ensure that if the appeal was lost that the City would not have expended $5,000 on new
decals, permits, licenses and other stickers that would then not be used.

As it turned out, the stay was lifted on January 13, 1982, by the Third District Court of
Appeals and the City's motion to reinstate the stay was denied on January 18, 1982.
Prior to the final denial of the stay a number of taxicab permit fees and license fees were
collected. In view of the City Commission's decision on October 15, 1981, and the
subsequent loss in the Court of Appeals, it is the Administration's recommendation that
these permit fees and license fees be reimbursed.
ADMINISTRATION RECOMMENDATION:
In compliance with the City,Commission's direction of October 15, 1981, all permit fees and
license fees collected afte October 15, 1981, be reimbursed. Total fees to be reimbursed
are approximately $2,580. _ ___.
