RESOLUTION NO. 82-16968
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, AUTHORIZING THE ABANDONMENT OF A CITY
UTILITY EASEMENT AND VACATING SAME, CONDITIONED UPON THE
RELOCATION OF CERTAIN UTILITIES AT THE GRANTEES' EXPENSE;
AUTHORIZING THE EXECUTION OF A QUIT-CLAIM DEED EVIDENCING
SUCH VACATION AND ACCEPTING AN ALTERNATIVE UTILITY
EASEMENT. (portions of 67th through 69th Streets from Collins
Avenue to Harding Avenue - Publix Market)
WHEREAS the owners of the real property described as the west five (5) feet
of Lots 13 through 16 and the east five (5) feet of Lots 19 through 22, Block 6,
AMENDED PLAT SECOND OCEANFRONT SUBDIVISION, according to the Plat
thereof, located in Plat Book 28 at page 28 of the Public Records of Dade County,
Florida, have petitioned the City Commission of the City of Miami Beach to vacate
said utility easement; and
WHEREAS said easement has been abandoned by the public; and
WHEREAS the vacation of the subject easement is deemed to be in the best
interest of the City of Miami Beach and its citizens, provided that the grantees of
said vacated easement relocate, at their own expense, the utilities in said
easement, and that said grantees dedicate to the City an alternative easement as
required by the Public Works Department of said City; and
WHEREAS the Public Works Department of the City of Miami Beach
recommends that the City vacate the west five (5) feet of Lot 13 less the south
five (5) feet thereof, and the west five (5) feet of Lots 14, 15 and 16, and the east
five (5) feet of Lot 22 less the south five (5) feet thereof, and the east five (5) feet
of Lots 19, 20, and 21, Block 6, in said subdivision, and accept as an alternative
easement the south five (5) feet of Lots 13 and 22, in said Block and Subdivision,
and
WHEREAS the said owners and parties of interest agree that they will pay
the full cost of abandoning portions of the existing water and sanitary sewer main
and constructing approximately two hundred (200) linear feet of a new twelve-inch
(12") water main estimated to cost $14,000, and to be located in the south five (5)
feet of Lot 13 and interconnected to the existing Collins Avenue water main and
also pay an estimated $2,100 to construct a sanitary sewer manhole, and
abandonment of existing sanitary sewer main,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City surrender all its right,
title and interest to the property hereinabove described and authorize the
execution of a quit-claim deed evidencing same, conditioned upon the relocation of
the utilities in said easement by the grantees of the quit-claim deed and accepting
an alternative easement dedication as required by the Public Works Department of
the City of Miami Beach.

DEED GRANTING EASEMENT TO THE CITY OF
MIAMI BEACH, FLORIDA
THIS INDENTURE made this ` day of March, 1982 , by and
between PATRICIA W. CRIMI , MICHAEL J. CRIMI , PRISCILLA W. HEARNE,
formerly PRISCILLA W. RIGGS, as owners of the following described
property, and PUBLIX SUPER MARKETS, INC. , a Florida corporation,
as Lessee in possession of the following described property,
Parties of the First Part, and THE CITY OF MIAMI BEACH, FLORIDA,
a municipal corporation, under the laws of the State of Florida,
and its successors in interest, Party of the Second Part.
WITNESSETH:
That said Parties of the First Part, for and in consideration
of the sum of $1 .00 to them in hand paid by the Party of the
Second Part, receipt whereof is hereby acknowledged, and for
other good and valuable consideration, does hereby grant, bargain
and sell to the Party of the Second Part and its successor in
interest an easement for the purpose of the installation and
maintenance of public utilities over, under and upon the following
described land situate, lying and being in the City of Miami
Beach, County of Dade, State of Florida, to-wit:
The South 5 feet of Lots 13 and 22, Block 6,
Second Oceanfront Subdivision, according to the
Plat thereof, recorded in Plat Book 28 at Page 28
of the Public Records of Dade County, Florida.

executed this instrument on the date first above written.

SUBJECT: REQUEST FOR ABANDONMENT OF EXISTING EASEMENT LOCATED
BETWEEN THE WEST SIDE OF LOTS 13 THROUGH 16 and THE EAST SIDE
OF LOTS 19 THROUGH 22, BLOCK 6, SECOND OCEANFRONT
SUBDIVISION, PLAT BOOK 28, PAGE 28 (PORTIONS OF 6711-1 THROUGH
69TH STREETS FROM COLLINS AVENUE TO HARDING AVENUE)
The owners of the above captioned property, and Publix Super Markets, Inc., as lessee,
have requested the City to abandon the utility easement described above, to allow for
expansion of its store and facilities westward onto Lots 19 through 22 of said Block 6.
Two existing apartment buildings on the site will be demolished. The existing easement is
utilized by the various utility companies and Publix has agreed to satisfy the requirements
of these utilities. Florida Power and Light Company, Southern Bell, Peoples Gas System,
Inc. and Ultra-Corn of Dade County, Inc. have no objections to the abandonment of the
easement and have set forth their requirements as outlined in the attached letters.
The Public Works Department has reviewed the request and has no objection to the
abandonment provided the owner of the land and Publix agree to dedicate a new five-foot
easement along the south five feet of Lots 13 and 22, Block 6, of the above-captioned
subdivision, and pay for the construction of a new 12-inch water main to be located in one-
half of said new five-foot easement, at an estimated cost of $14,000 , and $2,100 for
construction of a new sanitary sewer manhole and abandonment of sanitary sewer main.
ADMINISTRATION RECOMMENDATION
That the existing easement, less the south five feet thereof, be abandoned, and in
exchange the owners dedicate a utility easement and pay all costs for relocating utilities
and the construction of a water main, as indicated on the attached sketch, estimated to
cost approximately $14,000 and an estimated $2,100 to construct a new sanitary sewer
manhole in the new easement to be dedicated, and abandonment of the existing sanitary
sewer main.
