A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA ACCEPTING A WARRANTY
DEED FROM BYRON MARINA CORPORATION.
(road-widening purposes at 8100 Byron Ave.)
WHEREAS, for reasons more particularly set forth in
Commission Memorandum No. 202-82 , the City Commission of the City
of Miami Beach deems it in the best interest of the citizens of
the City of Miami Beach to accept the attached warranty deed,
NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Miami Beach, Florida to accept the attached
warranty deed from Byron Marina Corporation on the behalf of the
City of Miami Beach.

Acceptance of Warranty Deed for Road-Widening Purposes at 8100
BYRON AVENUE), LOTS 1, 2 and 3, less the East 2.5 feet, Block 7,
Haynesworth Beach Subdivision, Plat Book 41, Page 2.
On May 4, 1979, Byron Marina Corporation, owner of the above captioned property,
was granted a variance by the Board of Adjustment to exceed by 4,284 square feet
the required floor area of a proposed 40-unit condominium complex. Several
stipulations were imposed, one of which required that the owner deed to the City
"sufficient land at the southeast corner of Lot 1 in order to alleviate the hazardous
condition at the intersection of Tatum Waterway Drive, Byron Avenue, and 81st
Street."
An executed warranty deed dated March 10, 1982 has been submitted to the City by
the owner, deeding a parcel of land as shown on the attached sketch. A proposed
resolution, copy of which is attached, has been prepared by the City Attorney's
Office authorizing the City to accept the property and to execute the warranty deed.
ADMINISTRATION RECOMMENDATION
That the City Commission adopt a resolution authorizing the City to execute the
warranty deed submitted by the owner of the subject property in accordance with the
terms of the variance granted by the Board of Adjustment on May 4, 1979.
