RESOLUTION NO. 82-17029
A RESOLUTION CALLING A PUBLIC HEARING
ON RECOMMENDATION OF THE MIAMI BEACH
PLANNING BOARD TO AMEND THE FUTURE
LAND USE MAP OF THE 1980 MIAMI BEACH
COMPREHENSIVE PLAN
WHEREAS, the Miami Beach Planning Board, at a public hearing on May 18,
1982, recommended approval of a change of zoning from RM-100 Multiple Family Medium
High Density to C-4 Business for the property located at 280 41st Street, otherwise
known as Moulin Rouge Hotel. The legal description for the property is as follows:
Lot 29; Block 3; Flamingo Terrace Subdivision, According to the Plat thereof
as recorded in Plat Book 10, at Page 3 of the Public Records of Dade County,
Florida; Less the Following: The northerly seven and one-half (7V2) feet of said
Lot 29, and also that portion of the said Lot Twenty-nine (29), bounded as
follows: Commence at the northeasterly corner of said Lot Twenty-nine (29);
thence run in a westerly direction along the northerly line of said Lot Twenty-
nine (29) a distance of sixty-five (6.5) feet to a point; thence deflecting to the
left ninety (90) degrees running in a Southerly direction seven and one-half
(7Y2) feet to the point of beginning of tract of land herein described. From said
point of beginning run in an easterly direction along a line parallel to the
northerly line of said Lot Twenty-nine (29) for a distance of sixty-five (65)
feet, more or less to a point on the easterly line of said Lot Twenty-nine (29)
to a point, which is fifteen (15) feet southerly of the northerly line of Lot
Twenty-nine (29), measured at right angles to said northerly line of Lot
Twenty-nine (29); thence westerly along a line for a distance of sixty-five (65)
feet, more or less, to the point of beginning; as said lot, block and subdivision
are shown on Plat recorded in Plat Book 10, Page 3, of the Public Records of
Dade County, Florida, and
WHEREAS, Florida Statute (s.163.3194(1) requires that all land development
regulations enacted or amended shall be consistent with the adopted Comprehensive Plan
or element or portion thereof, and
WHEREAS, a change of land use classification on the Future Land Use Map of
the 1980 Miami Beach Comprehensive Plan is required to reassign the subject property
from the Residential 0-24 units/acre classification to the Residential/Commercial
maximum 125 units/acre classification, and
WHEREAS, said action of the Planning Board has been duly transmitted to the
City Commission pursuant to Section 16 Changes and Amendments of Zoning Ordinance
No. 1891.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that a Public Hearing for the consideration of
the aforementioned proposed change of land use classification, is hereby called to be held
before the City Commission, at its Chambers on the Third Floor of City Hall, 1700
Convention Center Drive, Miami Beach, Florida, beginning at 4:30on the 7th day of July,
1982 and the City Clerk is hereby authorized and directed to publish appropriate Public

Notice of said Public Hearing to be published in a newspaper of general circulation in the
City of Miami Beach, at which time and place all interested parties will be heard.
