A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, PURSUANT TO CITY OF MIAMI BEACH CODE SECTION 2-462(c),
GRANTING A WAIVER, BY 5/7THS VOTE, OF THE CITY'S POST-SERVICE
EMPLOYMENT PROHIBITION, IN CONNECTION WITH FORMER CITY
COMMISSIONER JOY MALAKOFF'S PROPOSED SERVICES RELATING TO THE
CITY'S GENERAL OBLIGATION BOND PLANNING AND OUTREACH EFFORTS,
FINDING THAT THE PUBLIC INTEREST WOULD BE SERVED BY SUCH WAIVER.
WHEREAS, pursuant to City of Miami Beach Code Section 2-462 "Prohibiting Members of City
Commission from Having Certain Post-Service Contracts with City," members of the City Commission
are prohibited for a period of two years after leaving City service, from becoming an employee,
independent contractor, or agent of the City, other than in voluntary, non-compensated service; and
WHEREAS, Code Section 2-462(c) provides for waiver of this post-service employment
prohibition upon an affirmative five-sevenths vote of the City Commission, finding that the public
interest would be served by such waiver; and
WHEREAS, at the February 14, 2018 City Commission meeting, as part of Agenda Item R9D
(G.O.B. Program Update), the Administration proposed the engagement of former City Commissioner
Joy Malakoff to provide services in support of the City's proposed General Obligation Bond planning
and outreach coordination efforts ("GO Bond Program"), in the not-to-exceed amount of$50,000; and
WHEREAS, the Mayor and City Commission, by an affirmative 5/7 vote, hereby find that the
public interest would be served by granting the subject waiver with respect to the proposed
engagement of Commissioner Malakoff for a contract for GO Bond Program services.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of
Miami Beach hereby, pursuant to City of Miami Beach Code Section 2-462(c), grant a waiver, by
5/7ths vote, of the City's post-service contract prohibition, in connection with former City
Commissioner Joy Malakoffs proposed services relating to the City's general obligation bond
planning and outreach efforts, finding that the public interest would be served by such waiver.
