Resolution 4173 RESOLUTION NO. i173 WHEREAS, Talbot Realty Company, by N. S. Talbot, President, of 1010 West Avenue , Miami Beabb, Florida, proposes to construct a tim- ber pier, T shaped, 20 feet wide, extending into Biscayne Bay from their property at 10th Street and Feet Avenue, a total distence of 78 feet from the bulkhead line and the T head to be 100 fejt long, all as shown on a drawing designated Sheet 1 of 1 and entitled: "SKETCH TO ACCOMPANY PERMIT AP PL'N TO CONSTRUCT A TIMBER PIER IN BIS- CAYIN E BAY FOR TALBOT REALTY CO. 1010 WEST AVENUE MIAMI BEACH, FLA. ZURWELLE-WHITTAKER, TMC. ENGINEERS um BEACH, FLA. NOVEMBER 15,1937" and, WHEREAS, said plane have been presented to and considered by the City Council of the City of Miami Beach, Florida, and WHEREAS, the said City Council feels that the proposed etrre- ture will, by reason of its extending such a great distance out Into the bay and into navigable water, interfere with weterorsft plying up and down the bay front, and WHEREAS, the zoning ordinance of said City of Uipvi Beach pro- vides that piers or wharfs shall not extend into Biscayne Bay a dis- tance greater than 25 feet and also they are required, to keep back 5 feet from side line of their properties and. in the event this pro- posed structure were allowed to proceed under contemplated dimensions it would tend to work a hardship on the owners of other bay front prop erties where cur restrictions have in the past and will in the future be observed, Now, THEREFORE, SE IT RESOLVED by the City Council of the City of Miami Beach, Florida, in legal meeting assembled, thet the said City Council does hereby strenuously object to said proposed construction and urges the United. StatesEngineera Office of the War Department to deny the permit for this project. PASSED AND ADOPTED this 3rd day of Decem , L.
