RESOLUTION NO. 4402
A RESOLUTION OF THE CITY OF MIAMI
BEACH, FLORIDA, VACATING PART OF
LOT SEVEN (7) BLOCK FOUR (4) OF
OCEAN BEACH, FLORIDA ACCORDING
TO THE PLAT THEREOF RECORDED IN
PLAT BOOK 2 AT PAGE 38 OF THE PUB-
LIC RECORDS OF DADE COUNTY, FLORIDA
COVERING AN ENCROACHMENT OF A CERTAIN
BUILDING ERECTED ON THE REMAINDER OF
SAID LOT AND GRANTING SUCH VACATED
PORTION THEREOF TO THE OWNER OF SAID
LOT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That the following described portion of the East 12
feet of Lot 7, Block 4, Ocean Beach, Florida, accord-
ing to the plat thereof, recorded in Plat Book 2 at
Page 38 of the Public Records of Dade County, Florida, which is
encroached upon by that certain three story building known as the
Biltmore Apartments, as shown by sketch of survey made by Biscayne
Engineering Company, dated August 17, 1933, and recertified on
October 10th, 1938, copy of which sketch is attached hereto; said
encroachment being in varying amounts, the maximum encroachment
being approximately fourteen hundredths of a foot, be and the same
is hereby vacated and the use of such vacated portion be and the
same is hereby granted to the owner of the remainder of said lot
7, his heirs, legal representatives and assigns, subject to the
proviso hereinafter contained.
Provided, however, that if the building now on the
remainder of said lot and covering the above de-
scribed portion of said lot is ever moved, demolished,
destroyed by fire or rebuilt, then the above vacation of said por-
tion and the grant of the use of same shall be immediately revoked,
terminated and absolutely voided without any action on the part of
the City Council of the City of Miami Beach, Florida, and the said
portion so vacated shall then again become a portion of the street,
sidewalk and/or public way, of which said portion is now a part for
public use.
