Resolution 4417 RESOLUTION NO. 4417 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk be and they are hereby authorized and directed to enter into a contract with the Town of Surfside, Dade County, Florida, for the supplying of water by the City of Miami Beach to the Town of Surfside, ac- cording to the text of an agreement , a copy of which is attached hereto and made a part of this resolution as Exhibit No. 1. ' yor ATTEST : ity er• ► - vJ J I.0 ns tl—iA—VQ iJ�tiJ'�D ARTICLES OF AGREEMENT ARTICLES OF AGREEMENT, made and entered into this _TOL__ day of November, A.D. 1938, by and between CITY OF MIAMI BEACH, FLORIDA, party of the first part, and TOWN OF SURFSIDE, party of the second part, both municipal corpora- tions of the State of Florida, WITNESSETH : THAT, WHEREAS, City of Miami Beach has been furn- ishing to the inhabitants of Town of Surfside, water, and it is now desired by Town of Surfside to purchase such water as said Town might require from the City of Miami Beach at its master meter installed on Collins Avenue just north of the present city limits; NOW, THEREFORE, it is hereby agreed by and between said municipalities, that the said City of Miami Beach shall furnish to the said Town of Surfside at said master meter such water as is available at said point at and for the price of twenty (20¢) cents per thousand gallons, payable monthly on or before the tenth day of each month. And in consideration thereof, said Town hereby agrees to pay for such water so provided in the manner above set forth. It is, however, expressly understood by and between said parties that by the entering into of this agreement, said City of Miami Beach does not obligate itself to furnish any particular quantity of water, but that said Town under this agreement shall be entitled to only such water and under such pressure as may be available at such point at any time, but without discrimination as against said Town as compared with areas within the City of Miami Beach in said neighborhood. The Town of Surfside shall not operate or permit to be operated, on any of the water lines served through said master meter, any pump or pumping device, without the written permission of the said City of Miami Beach. McKAY, DIXON & DEJARNETTE, ATTORNEYS-AT-LAW, MIAMI, FLA. -1- I -t- It is understood and agreed that the City of Miami Beach has three (3) customers for water, to whom water is supplied through pipes running through the Town of Surfside and beyond the limits of said Town, to-wit: The Lighthouse, Chase' s Restaurant at Bakers Haulover, and Indian Creek Country Club, Inc. The Town of Surfside shall take over the furnish- ing of water to said customers but shall not serve any other customers similarly situated without the written permission of the City of Miami Beach. It is further agreed that this contract shall be terminated by either party by giving six (6) months notice thereof to the other in writing. This contract shall not become effective until the completion of certain extensions and improvements of the water distribution system of Town of burfside, undertaken under a loan and grant from Federal Emergency Administration Public Works, Florida docket F-1313.
