Resolution 4518 RESOLUTION NO. 4518 __ APPROVING AND AUTHORIZING THE -MIAMI BEACH RAILWAY COMPANY TO RENDER A MORE ADEQUATE TRANSPORTATION SERVICE IN THE CITY OF MIAMI BEACH BY THE ABANDON- -.ENT OF THE OPERATION OF STREET CARS UNDER ITS FRANCHISE IN MIAMI BEACH ON CERTAIN STREETS AND THE SUBSTITUTION OF GASOLINE MOTOR VEHICLES FOR SAID STREET CARS ON THE SAID STREETS, OR PORTIONS THEREOF; AUTHORIZING AND DIRECTING THE CITY CLERK, ON BEHALF OF THE CITY, TO JOIN WITH THE MIAMI BEACH RAILWAY COMPANY IN <<iA.KING APPLICATION AND TAKING SUCH OTHER STEPS AS MAY BE NECESSARY TO SECURE THE APPROVAL OF THE RAILROAD COMMISSION OF THE STATE OF FLORIDA, TO THE ABANDON°'LENT OF THE OPERATION OF STREET CARS, AND SETTING FORTH PROVISIONS RELATING THERETO. WHF,REAS, Section XII of Ordinance 205, being the fran- chise heretofore granted to The Miami Beach Railway Company and now in force and effect, provides, among other things, that changes in means and methods of transportation under said fran- chise may be made at any time and from time to time but only with the approval and on the authority of the City Council, and WEREAS, the Miami Beach Railway Company has requested authority and approval from the City Council to abandon the operation of street cars now operated on certain streets and to substitute gasoline motor vehicles for said street cars on certain streets,and WHEREAS, the City Council has been advised that the said abandonment is subject to the approval of the Railroad Commission of the State of Florida and that certain proceedings are necessary to secure such approval, including the filing of an application with the said Railroad Commission for authority to effect the abandonment of street cars aforesaid, and WHEREAS, the City Council believes it to be in the public interest that such substitution of gasoline motor vehicles for street cars take place, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1. That the City Council of the City of Miami Beach 4 I under and by virtue of the provisions of Section XII of that said franchise granted to The Miami Beach Railway Company and known as Ordinance 205, passed and adopted by the City Council of the City of Miami Beach on April 9, 1924, does hereby give its approval and authority for the change in the means and methods of transportation now existing under said franchise by the aban- donment by The Miami Beach Railway Company of the operation of street cars, and the substitution of gasoline motor vehicles for said street cars on the following streets and avenues and in either or both directions thereon in the City of Miami Beach, Florida, as follows: From the eastern terminus of the tracks now owned by the State Road Department of the State of Florida and formerly owned by Dade County, Florida, at or near the intersection of Fifth Street and Alton Road in a general southeasterly direction along Alton Road to the intersection of Alton Road and First Street; thence in an easterly direction along First Street to the intersection of First Street and Washington Avenue; thence in a southerly direction along Washington Avenue to the intersection of Washington Avenue and Biscayne Avenue, thence in an easterly direction along Biscayne venue to the intersection of Biscayne Avenue and Ocean Drive; thence in a northerly direction along Ocean Drive to the intersection of Ocean Drive and First Street; thence in a westerly direction along First Street to the intersection of First Street and Washington Avenue. Section 2. That the City Council of the City of Miami Beach also does hereby give its approval and authority to the change in the means and methods of transportation now existing under the franchise aforesaid, by the abandonment by The Miami Beach Railway Company of the operation of street cars, and the substitution of gasoline motor vehicles for said street cars, on the Dade County Causeway and in either or both directions thereon, in so far as the said Dade County Causeway is within the city limits of the City of Miami Beach. Section 3. That the City Clerk, on behalf of the City of Miami Beach, is hereby authorized and directed to join with The Miami Beach Railway Company in making application to the Railroad Commission of the State of Florida for authority to make -u- the abandonment of the operation of street cars aforesaid, and to take such other steps and proceedings as may be necessary to secure the approval of the said Railroad Commission. Section 4. That this Resolution shall be in force and effect from and after its passage and adoption by the City Council of the City of Miami Beach, and its acceptance by The Miami Beach Railway Company. Section 5. That none of the rights, privileges or fran- chise granted to The Miami Beach Railway Company by the said Ordinance 205 are affected in any manner by the pasage and adoption of this Resolution or the acceptance thereof by The Miami Beach Railway Company, or the abandonment of the operation of the said street cars and the substitution of gasoline motor vehicles for said street cars or by the operation of said gasoline motor vehicles in accordance with this Resolution. Section 6 . That the passage and adoption of this Resolution by the City Council of the City of Miami Beach shall be considered by the Railroad Commission of the State of Florida as the consent of the city Council of the City of Miami Beach to the abandonment of the operation of said street cars as hereinabove set forth.
