Resolution 4527 RESOLUTION NO. 4527
WHEREAS, the Miami Beach Congregational Church is
the owner of a tract of land bounded on the West by Pine Tree
Drive , on the North by Twenty-Fourth Street, on the East by
Liberty Avenue , and on the South by Collins Canal, and
WHEREAS, the Board of Trustees of said Miami Beach
Congregational Church are attempting to sell this property but
are prevented from doing so because of a clause in the Deed to
said property, which provides in effect that said property is
to be used for none other than church purposes, and
WHEREAS the parties that sold this tract to the said
church and who put into the Deed this clause have indicated
their willingness to remove said clause, provided all surrounding
property owners give their consent to the removal of said clause
in said Deed,
NOW, THEREFORE, be it resolved by the City Council
of the City of Miami Beach, Florida,
That inasmuch as the City of Miami Beach is the owner
of Lot Seven (7) in Block Four (4) of FLAMINGO TERRACE ADDITION,
they do hereby authorize the Mayor and the City Clerk for and in
behalf of the City of Miami Beach to give permission, in writing,
for the removal of the clause aforementioned in the said Deed
now held by the Miami Beach Congregational Church.
PASSED AND ADOPTED THIS 4th day of May, A. D. , 1939.
