WHEREAS, there has been presented to the City
Council of the City of Miami Beach, Florida, by Walter B. Wilson,
Realtor, Agent for the owners thereof, the following offer of
sale to the City of Miami Beach:

Gentlemen:
I have been authorized by Mary E. Peter, Executrix
and Residuary Devisee under the Last Will and Testament
of William R. Hodges, deceased, owner of Lots 7 and 8,
Block 112, Ocean Beach Addition #4, Miami Beach, Dade
County, Florida, with the improvements thereon known
as the Carter Building; and also the following parcel
of land and land under water:
Beginning at a point which is the intersection of
westerly line of Ocean Drive produced southerly and
center line of Biscayne Street thence easterly along
said center line of Biscayne Street for a distance of
279.54' to a point; thence northerly along a line at
right angles to above mentioned course for a distance
of 91 to point of beginning —; thence northerly along
said line at right angles to first mentioned course
for a distance of 24.1' to point; thence continued
northerly along line deflecting to the right 9 degrees
12 minutes 40 seconds from last mentioned course for
distance of 26.24' to point which is 59' northerly of
said center line of Biscayne Street; thence easterly
along line for a distance of 645.4' to point which is
58.?' northerly of said center line of Biscayne Street
produced easterly; thence southerly along line at
right angles to last mentioned course for a distance
of 94 4' ; thence westerly along line for distance of
149.9 ' to point which is 35.6' southerly of said center
line of Biscayne Street produced easterly; thence
northerly along a line at right angles to last mentioned
course for a distance of 43.91 ; thence westerly along
a line for a distance of 419.5' to point which is 8.8'
northerly of said center line of Biscayne Street
produced easterly; thence westerly along a line for a
distance of 80.2' to point of beginning as said drive
and street are shown on plat recorded in plat book 3
at page 151 Public Records, Dade County, Florida and
as said Biscayne Street is named and designated in
ordinance No. 232 of the City of Miami Beach, Florida
containing 0.9 acres more or less; together with the
improvements thereon known as the Million Dollar Pier;'

for Sixty-five/Dollars cash, subject to the following
leases:
MILLION DOLLAR PIER:
Berkow, Inc. (hot salt water baths) Covers West portion
of first floor of East Building on Pier.
Term ends five years from August 10, 1938.
Rent, $1,000.00 per annum first and second years, $1,100.00
per annum tnird and fourth years, and v$1,500.00 fifth year.
Lease may be canceled if Pier is sold by giving 6o days
notice, but tenant cannot be called upon to vacate from
December 1st to April 1st. If lease is canceled, tenant
is to be paid the following percentages of his cost of
equipment - $7,488.00. In the second year % 80%, third
year 60%, fourth year 40% and fifth year 206.
Bar Pilots Covers small office at northeast corner of
second floor of East Building On Pier.
Term ends July 1, 1942. Lease may be canceled on 60 days
notice if Pier is sold.
Rental $40.00 a month.
CARTER BUILDING:
Frank Phelan and Preston King (Greynound Bar) Covers
stores #3 and #4 at east end of first floor building.
Term ends - July 1, 1940.
Rent, $1,000.00 payable $100.00 down and $100.00 September
1st November 1st and December 1st; $200,00 January 1st,
February lst and March 1st.
City of Miami Beach ( rublic Comfort Station)
Term ends October 1, 1940. City has option of extending
term up to August 1, 1943 one year at a time on giving
90 days notice of exercise of option;
Subject also to the usual prorations, the closing to be
in conformity witn the provisionslf Section 26 of tne City
Charter.

NOW, THEREFORE, be it resolved by the City Council
of the City of Miami Beach, Florida, that said offer he and tne sate
is hereby accepted, subject to the provisions of Section 26 of
the City Cnarter of said City, and subject to the approval of title
thereof by the City Attorney, and that the Mayor and City Clerk be

and they are hereby authorized and directed to execute such
instruments as may be necessary to carry out the purpose of
this resolution.
