A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA
WHEREAS, application has been made to the War Depart—
ment, by Hatfreid, Inc. , for permission to construct a sheet
Steel Groyne in the Atlantic Ocean at the east end of lath
Street , in the City of Miami Beach, as evidenced by a sketch
prepared by Zurwelle—Whittaker, Inc. , Engineers, marked Sheet
1 of 1 and dated June 15, 1940 (Revised July 1, 1940) , and
WHEREAS, the said application has been considered by
this Body,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that we do hereby seriously
and strenuously object to said proposed construction at the
contemplated location on the following grounds, to—wit:
(1) We contend that title to all land lying
east of the east subdivision line (Fisher' s
First Subdivision of Alton Beach) and par—
ticularly this area under consideration,
which is an extension of 18th Street as
platted, is vested in the public , and as there
is pending and further contemplated litigation
in the near future to determine the status of
same, therefore no private construction of
any character should be permitted at this
location.
(2) If this construction should be permitted in
another location we object to the contemplated
elevation of the bulkhead end of the groyne,
which to make formoredom in e
withge alland down the beachnd toconformithll
other similar groynes previously constructed
along our shore should be plus 6' — 0" in-
stead of plus 8' - 0" ,
However, owing to the urgent necessity for this protective
construction,
BE IT FURTHER RESOLVED that if the said applicant will
revise their application, moving the contemplated groyne con—
struction to a location outside of the area between
the

and south lines of 18th Street, extended easterly, and
will change the elevation of said groyne to six feet instead
of eight the abovelow water,objectionsttossaidywill and
