Resolution 5226 RESOLUTION NO. 5226 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA. WHEREAS, the following order was issued as of November 25th, 1940, by the Honorable Henry L. Stimson, Secretary of War, to wit: "203.447 Biscayne Bay, Fla. , bridge (highway) 13th St., Miami, Fla. In accordance with the provisions of Section 5 of the River and Harbor Act approved August 18, 1894 (28 Stat. 362; 33 U.S.C. 499) , the following special regulations are prescribed to govern the operation of the east and west drawspans in the bridge of the State noad Department of Florida across Biscayne Bay at 13th Street in the City of Miami, Florida. (a) During the period from December 20 to March 15, both dates inclusive, the owner or agency controlling the bridge shall not be required to open the east and west drawspans between the hours of 7:00 a.m. and 9:00 a.m., except that the east drawspan shall be opened on the half hour and even hour for sufficient time to pass any vessels awaiting passage. (b) During the same period the owner or agency controlling this bridge shall not be required to open the east and west draw- span between the hours of 4:30 p.m. and 6:30 p.m., except that the west drawspan shall be opened on the half hour and even hours for sufficient time to pass any vessels awaiting passage. (c) Either draw shall be opened at any time when required by a tow, or in an emergency. (d) Officers of the Police Departments of Miami and Miami Beach shall be stationed at the respective draws and at the ends of the causeway during the above hours to regulate traffic in con- junction with the bridge tender. (e) These regulations shall be for the 1940-41 season only, and they may be revoked in the discretion of the Secretary of War. (f) Boat owners shall cooperate insofar as possible to facilitate the operation of the draws of this bridge. (g) These temporary regulations shall be in effect from December 20, 1940 to March 15, 1941 and are supplemental to the "Rules and regulations to govern the operation of drawbridges crossing all navigable waterways of the United States discharging their waters into the Atlantic Ocean south of and including Chesapeake Bay and the Gulf of Mexico, excepting the Mississippi River and its tributaries." approved November 25, 1940. /8/ Henry L. Stimson Secretary of War" and WHEREAS, this regulation of drawspan openings, this past winter season, has been of inestimable value in helping relieve a very acute traffic congestion problem on this Causeway between the Cities of Miami and Miami Beach - NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that we do hereby again petition the War 7 Department to make a similar regulation for the next winter season of 1941-1942, and we further petition and request that the time limit for this regulation be extended to include the period December 1st, 1941 through April 1st, 1942, and BE IT FURTHER RESOLVED that this Body does hereby extend to the Honorable Henry L. Stimson, Secretary of War, its thanks and appreciation for his cooperation this past season in giving us this much needed help. PASSED AND ADOPTED this 16th day of April, A. D., 1941.
