40 Year Recertification of the Fillmore Miami Beach
Funding for Restrooms at Collins Park Rotunda
The purpose of this Letter to Commission is to provide you with an update on recommendations
made by the Cultural Arts Council regarding the 40 year recertification of the Fillmore Miami Beach
and funding options for restrooms facilities at the Collins Park Rotunda.
Forty Year Recertification of the Fillmore Miami Beach
In November 2016, A structural and electrical inspection was completed at the Fillmore Miami Beach
for the required 40 year recertification process, and it was determined that some actions and
significant repairs are needed before this building could be recertified. These repairs, which include
structural and electrical deficiencies, would need to occur in order to conform to the minimum
inspection procedural guidelines as issued by the Miami -Dade County Board of Rules and Appeals.
At the request of the Office of Budget and Performance Improvement, the Cultural Arts Council was
asked to consider use of the Cultural Arts Council Endowment as a funding source for the 40 year
recertification. As detailed in the Cultural Arts Council Master Plan (Resolution No. 98-22760) and
Cultural Affairs Strategic Plan (Resolution No. 2014-28732), the Cultural Arts Council can
recommend use of funds for capital improvements at Miami Beach cultural facilities. The attached
memorandum (Attachment 1) was prepared by staff from Property Management and presented to
the Cultural Arts Council Members for their review and consideration on April 5, 2018.
On April 5, 2018, the Cultural Arts Council met and a motion was made by Cheryl Jacobs, seconded
by Israel Sands and passed unanimously stating the Cultural Arts Council Endowment should not be
used to support the costs associated with the repairs necessary to establish recertification for the
Fillmore, which total $654,734.30. It was further stated that the 40 year certification is standard
procedure and this expense should have been anticipated and taken into consideration during the
annual budget process. The Cultural Arts Council recommended other sources of funding should be
identified.
Funding for Restroom Facilities at Collins Park Rotunda
During the April 26, 2017 City Commission meeting, a motion was made to proceed with the Cultural
Arts Council's plan to convert the Rotunda into an artist designed performing arts space. Funding for
this project was allocated on September 13, 2017 when the City Commission approved by
Resolution 2017-29969 the use of $800,000 from the Cultural Arts Council Endowment to fund the
transformation of the space. The scope for the total allocated amount of $800,000 from the Cultural
Arts Council Endowment to convert the Rotunda into a functioning performing arts venue is to
include design, engineering, fabrication, installation, and all code and building requirements
associated with the renovation including restrooms, accessibility and life safety systems, among any
other necessary requirements.
On February 20, 2018, the three artists presented their site specific project proposals to the Art in
Public Places Committee, members of the Cultural Arts Council, community representatives and
staff, despite not meeting the requirement of providing a restroom solution, as described in the
solicitation. With the exclusion of the restrooms, the proposing budgets did allow for accessibility, life
safety, design, engineering, fabrication, installation and additional stated requirements of the Call to
Artists as related to the existing Rotunda space.
On March 2, 2018, the Cultural Arts Council made a unanimous motion to recommend Mexico City
based Frida Escobedo's design. A second motion was made by the Cultural Arts Council directing
staff to identify a solution for restroom facilities to serve the Rotunda. Recommendations included
identifying funding for the construction of new restroom facilities as part of the City's capital budget
process or request funding for purchase of pre -fabricated portable restrooms as part of the City's
capital budget process, including potential funding from the Cultural Arts Council Endowment. Any of
the above solutions should be realized in collaboration with the recommended artist.
None of the three proposing artists were able to design an accessible restroom facility with life
safety systems within the originally allocated budget. Upon further research conducted by each of
the proposing artists, all of the proposing artists concluded that an accessible restroom facility would
need to be located outside of the existing interior rotunda space, as the incorporation of an
accessible, interior restroom would require a significant amount of square footage, greatly reducing
capacity and performance space.
On April 5, 2018, the Cultural Arts Council met and a motion was made by Laurence Moser,
seconded by Britta Hanson and passed unanimously stating staff should continue to work with
Capital Improvement Projects to further refine the cost estimate, scope of work and determine code
requirements for the restroom facilities and to return to the Cultural Arts Council with an update
at the May 3, 2018 meeting.
Ideally, funding for the restroom facilities should be identified prior to the submittal of the artists'
design to Historic Preservation Board. At the April 11, 2018 City Commission meeting, a referral was
made to the Finance and Citywide Projects Committee to discuss restroom facilities for the Collins
Park Rotunda.

Introduction
MEMORANDUM
The Fillmore Miami Beach at the Jackie Gleason Theater is a three story theater building with
structural walls in concrete. A structural and electrical inspection was completed for the required
forty year recertification process and it was determined that some actions and significant repairs
needed to be accomplished before this building could be recertified. This would need to occur in
order to conform to the minimum inspection procedural guidelines as issued by the Miami -Dade
County Board of Rules and Appeals.
Structural Deficiencies
• Cracks in walls at handicapped entrance to rehearsal hall need repair
• Unsupported edges of openings in interior masonry walls to the sides of the proscenium
opening require review and will likely require support, removal, or in -fill
• Repair areas of damaged stucco
• Roof, ventilation fans, and other equipment leaks need repair
• Review corroded rooftop equipment and supports in several locations. Repair or replace
any members which are significantly weakened and clean and coat other areas with rust -
inhibitive paint
• Clean leaves, debris and dirt from low roofs
• Review corroded anchors for exterior steel ladders. If not significantly corroded, clean
and coat with rust -inhibitive paint. If significantly corroded, replace with new anchors
• Review corroded brackets for truck dock bumpers. Repair or replace steel members
which are significantly corroded. Clean and coat other members with rust inhibitive paint
• Review Building Code requirements for fireproofing of structural steel, and if required,
provide repairs to areas of lost fireproofing
• Repair catwalk railings
• Review shoring posts under stage lift. If support is required, provide appropriately
engineered, permanent support.
• All areas of spelled concrete and exposed reinforcement should be repaired in
accordance with ICRI guidelines
• All areas of loose stucco should be removed and patched
• Roof and wall leaks should be sealed
Electrical Deficiencies
• Dirt and debris accumulated on switchboards
• Generator shows oils stain
• Debris accumulated inside generator
• Poor illumination in transformer room
• Conduit not properly ended
• Penetration to adjacent section not sealed

• 3 -pole breaker in position 14,16,18 needs to be removed to the bottom to avoid strain on
branch circuit wires
• Properly sized UL listed lugs must be provided for neutral and grounding wires
• Gutter must be provided a cover
• Combustible material (wood) must be removed from gutter. Coaxial/auxiliary cable
cannot run through gutter
• Emergency light not operative
• Openings not properly sealed
• Abandoned wires must be identified and removed
• J -boxes needs to be covered
• Disconnect needs to be locked in the off position with pad lock
• Outgoing lugs do not match wire sizes
• Grounding lug not acceptable for cable size
• Exit sign is blocked by metal detector, other sign is not illuminated
• Perforated walls breaking the fire rating for the area
• Inaccurate circuit directory for "PA"
• Abandoned branch circuits on panel "PA"
• Breaker feeding two branch circuits on panel "PA"
• Breaker feeding two branch circuits in panel "LS"
• Provide accurate circuit directory for panel "LS"
• Wires penetrating wall without fire stopping array
• Improperly sealed penetration on the wall and electrical and communication cables to
electrical conduit
• High ampacity tie cables on floor. Disconnect needs to be locked in off position with pad
lock

Conclusion
It is imperative that this facility receive the mandatory recertification. Without this recertification,
Miami -Dade County has the authority to notice the City of Miami Beach to vacate the facilities
until the structural deficiencies are remedied. This notice would require an emergency response
and negatively impact the operations at this facility.
