This memorandum is to inform you of the actions taken by Neighborhood Services
Department, Code Compliance Division in response to the recent article that appeared in
The Miami Herald on December 10, 2002, concerning the above-mentioned location. A
copy of the article is attached for your review.
The article states that the single-family home located at 4462 North Bay Road is available
for short-term rentals, including parties, weddings and corporate events. The article
indicates a rental fee of $4,00 to $12,000. The article further states that the real estate
agent, Leonard Weinschneider, is marketing the home as a hotel or as fractional ownership
where a group of large corporations would get annual one-month stays at the property.
The property is zoned RS-3, single-family residential district. Single-family residential
districts are designed to protect the character ofthe single-family neighborhoods. The main
permitted uses in the single-family residential districts are single-family detached dwellings,
The accessory uses in the single-family residential districts are those uses customarily
associated with single-family homes. In February of 2000, Mr. Jorge Gomez, Director,
Planning Department issued a written opinion regarding Section 142-102, of the land
development regulations of the City Code, that a single-family home could only be leased
for a minimum period of six (6) months.
A search of city records revealed that the current property owner, Michael Burke, was cited
in December of 2001 for short-term rentals. Staff researched and found an Internet site
advertising short-term rentals for the above-mentioned location. Since the web site was
discontinued, no further action was taken by the city.
Immediately after the article was published, Mr. Eric Wardle, Assistant Director, Code
Compliance Division contacted the realtor for the property. The realtor was informed that
the activity published in The Miami Herald article is prohibited and that enforcement action,
which may include Special Master tines of up to $15,000.00, would be initiated if violations
occurred. This information was reiterated to Mr. Weinschneider in a letter from the code
compliance director (see attached). Mr. Weinschneider has indicated that no short-term
rentals have taken place and now that he is aware of the City regulations, he agreed to
cease and desist from any such activity.

The Code Compliance Division received numerous phone calls by residents who had read
the article and were concerned that the property would be converted into a commercial
establishment. The Code Compliance Division will continue to monitor the property for any
prohibited activity.

This letter is to follow-up with you conceming your conversation with Eric Wardle, Assistant Director,
Code Compliance.
You were quoted in a Miami Herald article on December 10, 2002, The article was written by Nery
Ynclan. The article indicated that the single-family home located at 4462 North Bay Road was
available for short-term rentals, including parties, weddings, and corporate events. The article
indicated a rental fee of $4,000,00 to $12,000.00. The article quoted that you were marketing this
home as a hotel or a fractional ownership where a group of large corporations would get an annual
one-month stay at the property,

Director has issued a written opinion with respect to the land development regulations of the city
code, that a single-family home could only be leased for a minimum period of six (6) months,
Violations of the city code are prosecuted under Chapter 30 before a Special Master. The Special
Master has the authority to impose fines up to $15,000.00 for non-correctable violations, A lien will
be placed on the property for any unpaid fines. Foreclosure proceedings would be initiated after
three (3) months if the lien remains unpaid.
