Resolution 5403 RESOLUTION N0. 5403 WHEREAS, it appears from a survey and blue-print made by August DeWinkler, Registered Engineer and Surveyor, on November 7th, 1941, that a certain part of the building on the southeast corner of Pennsylvania Avenue and Lincoln Road, in the City of Miami Beach, Florida, situated on Lots 3 and 4, Block 52, Second Commercial Subdivision, according to plat thereof recorded in Plat Book 6, at Page 33, of the Public Records of Dade County, Florida, encroaches upon the sidewalk surrounding said property, as shown on said survey and blue- print prepared by August DeWinkler, Registered Engineer and Surveyor, a copy of which is attached hereto and made a part hereof, and WHEREAS, it further appears that said encroachment does not materially affect and interfere with the use of said side- walk; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the aforesaid encroachment be allowed to remain for and during the life of said building.
