Resolution 5473 RESOLUTION NO. 5473 WHEREAS, the City Council cn the 21st day of January, 1942, passed and adop' ed Ordinance ;1635 which mended Ordinance #391 of the City of Miami Beach, Florida, said ordinance providing, among other thins, that if places of business of vendors licensed under sub-section (g) of Section 7 of Ordinance #391 to operate bars accessible to the public shall be soundproofed and their windows , doors and other openings kept closed in order that the noise there- from may not disrupt the peace and quiet of the neighborhood, then and in that event, string music and radio in the places of business of said vendors may be provided until 1:00 o' clock A.M. , and WHEREAS, said Ordinance i'635 became a law and became effective on the 21st day of February, 1942, and uwHEREAS, at a meeting of the City Council on February 20, 1942, the City Council instructed the City Clerk to "refer applicants to the Building Department for their inspection as to whether or not such bars are soundproofed and meet the requirements of the ordinance", and WHEREAS, the City Council believes that the enforce- ment of the provisions of said ordinance does not come within the duties of the City Clerk, nor within the duties of the Building Department, but that the responsibility for the enforcement thereof rests upon the Police Department ; NOW, THEREFOYE, BE IT RESOLVN:T) by the City Council of the City of Miami Beach, Florida, that the action of the City Council on February 20, 1942, whereby the City Clerk was instructed to refer applicants for the privileges extended by Ordinance #635 to the Building Department, be and the sane is hereby rescinded. BE IT FURTHER RESOLVED by the City Council of the City of Miami Beach, Florida, that the Chief of Police be and he is he:ieby instructed to direct the Police Department to enforce the terms of said Ordinance ;x635 and to see that no bars accessible to the public, and licensed under sub-section (g) of Section 7 of Ordinance ;1391 provide music or entertain- ment in the places of business of said vendors later than midnight unless such place of business shall be soundproofed and the windows, doors and other openings thereof kept closed in order that the noise therefrom may not disrupt the peace and quiet of the neighborhood.
