RESOLUTION NO. 5507
WHEREAS, during the year 1934 a building was erected
upon Lot Three (3) and the North one-half of Lot Four (4) ,
Block Fifty-nine ( 59) , Ocean Beach Addition #3, leaving a
front yard having a depth of only Twenty-two and Seventy-
eight one-hundredths (22.78' ) feet ; and
WHEREAS, the Zoning Ordinance of the City of Miami
Beach requires, and on said date did require, that there
should be a front yard having a depth of not less than Twenty-
five .f'25' ) feet ; and
WHEREAS, it appears to the City Council that the vio-
lation of the requirements is of a trivial nature and was
unintentional and caused by an error of the contractor; and
WHEREAS, it has been made to appear to the City Council
that the violation of the Ordinance has prevented the owner
from selling or borrowing upon said property,
NOYV THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida, that so far as this Council
has the power to bind the City of Miami Beach in the premises,
no action of any kind whatsoever shall be taken by said City
to require the owner, his heirs, or assigns, to move, or re-
move, the structure, or structures, on said lands by reason of
said violation of said Ordinance.
PASSED and ADOPTED this 15th day of April, A. D. 1942.

with a survey of the property made under my direction, and that there are no
encroachments unless shown or noted hereon, and that the said sketch is ac-
