249-96 RDA RESOLUTION NO. 249-96 A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY (THE "RDA") AUTHORIZING THE EXECUTIVE DIRECTOR OF THE RDA TO PAY, WHEN AND IF DIRECTED BY THE GENERAL COUNSEL OF THE RDA, UP TO AN AMOUNT EQUAL TO 1.7 MULTIPLIED BY THE APPRAISED VALUE, TO ACQUIRE FEE SIMPLE TITLE TO THE PROPERTY COMMONLY KNOWN AS THE JUSTICE OF THE PEACE BUILDING, IN CONNECTION WITH PENDING EMINENT DOMAIN LITIGATION REGARDING THAT PROPERTY ORA SETTLEMENT OF THAT LITIGATION. WHEREAS, the Miami Beach Redevelopment Agency (the "RDA") has instituted eminent domain litigation to acquire fee simple title to the property (the "Property") commonly known as the Justice of the Peace building, having a street address of 1575 Washington Avenue, Miami Beach, Florida; and WHEREAS, if the Court awards the Property to the RDA, the RDA will be required to pay monies and, because such payment may have to be made before the RDA returns from its summer recess, the RDA should authorize at this time, subject to the conditions in this resolution, the Executive Director to pay those monies. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN AND MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY as follows: 1. The Executive Director of the RDA is authorized to pay, when and if directed by the General Counsel of the RDA, up to an amount equal to 1.7 multiplied by the highest appraisal obtained by the RDA or the City of Miami Beach concerning the Property, which amount includes all fees and costs, except fees and costs attributable to the RDA's special counsel, to acquire fee simple title to the Property, in connection with an order of taking or a settlement agreement. 2. The Executive Director of the RDA, General Counsel of the RDA and Special Counsel for the RDA, and their respective designees, are authorized to take all other actions incidental to effectuating the purposes of this resolution. 3. This resolution shall take effect immediately upon its adoption.
