Resolution 5604 RESOLUTION NO. 560+
WHEREAS, the City Council of the City of Miami Beach,
Florida, has heretofore, by resolution, pledged its participa-
tion in the county wide health unit known as "Dade County Health
Unit" , provided that Dade County, Dade County Board of Public
Instruction, the City of Miami, and the City of Coral Gables
also participated; and
WHEREAS, to accomplish the effective expansion and consoli-
dation of said Dade County Health Unit it is necessary that a
written agreement be entered into by said participating parties;
and
WHEREAS, a proposed form of agreement has been submitted
to the City of Miami Beach which said form of agreement reads
as follows, to-wit:
WHEREAS under the provisions of Chapter 14906, Laws of
Florida, 1931 (Section 2934 Cumulative Supplement, 1930 the several
counties of the State of Florida and the Cities therein are authorized
to cooperate with the State Board of Health in the establishment and
maintenance of full-time local health units in such counties for the
control and eradication of preventable diseases and to inculcate
modern, scientific methods of hygiene, sanitation and the prevention
of communicable diseases; and
WHEREAS Dade County, Florida, in cooperation with the Florida
State Board of Health, has heretofore established a full-time health
unit under the provisions of the chapter aforesaid, which unit is
now in operation; and
WHEREAS because of the emergency resulting from the present
World War and conditions attributable thereto it is considered that
the best interests of Dade County and the municipalities therein will
be served by enlarging the health unit aforesaid so as to bring with-
in such unit the undersigned municipalities within Dade County and
so eliminate a duplication and an overlapping of authority and work
and secure more efficient and economical service; and
WHEREAS it is considered that the interests of the public wel-
fare and health make advisable the establishment and maintenance of
one coordinated public health unit or agency for all Dade County
in lieu of the numerous disassociated public health agencies now
maintained by the County and the several municipalities therein; and
WHEREAS experience has shown that proper control and eradica-
tion of communicable diseases cannot be successfully accomplished
without unified control and the consolidation of funds available for
such purpose; and
WHEREAS it is considered that the consolidation of the various
appropriations by the undersigned parties for health purposes will
enable the establishment of a more efficient health unit and will
also increase to a considerable extent the amount of state and federal
funds to be contributed for such purposes; and
WHEREAS the Dade County Board of Public Instruction and the
Superintendent of said Board have expressed a desire for the enlarge—
ment of county health supervision and control in order to bring
about a better health condition among the school children of Dade
County and have pointed out that closer supervision of health
conditions in the schools would result in greater attendance, with
the resultant effect that this increase in attendance would produce
greater financial support from the State; and
WHEREAS the undersigned Dade County Board of Public Instruction
has heretofore appropriated substantial sums of money from year to
year for the purpose of employing personnel in the supervision of
health conditions and in the eradication of communicable diseases
among the school children of Dade County, Florida, and considers that
appropriations made direct to the Dade County Health Unit will better
accomplish the purpose of protecting the health of the school children
of Dade County and eliminate the necessity of the schools' maintain—
ing employed personnelf or such purpose; and
WHEREAS in fairness and in equity the municipalities of Dade
County should contribute to the cost of establishing, operating and
maintaining such county health unit for the benefit of the citizens
of said municipalities as well as for the benefit of the citizens of
the entire county;
NOW, THEREFORE, the undersigned hereby agree to abide by the
provisions herein contained and pertaining to the enlargement of the
Dade County Health Unit, viz:
1. At twelve o' clock midnight, November 10, 1942, the several
health departments now maintained by the undersigned municipalities
and by the Dade County Board of Public Instruction shall be discon—
tinued, and all quarters, offices, furniture, equipment or appurten—
ances of the discontinued departments shall be transferred to the
custody of the Dade County Health Unit;
2. Each party to this agreement shall appoint one person as
its representative, and the person so appointed together with three
physicians appointed by the Dade County Medical Association shall
constitute the members of the Dade County Health Unit Advisory
Board;
3. Upon the effective date of this agreement each of the

undersigned parties shall relinquish and transfer to the Dade
County Health Unit all authority and prerogative heretofore vested
in said party pertaining to public health, except that in trans—
ferring such authority the parties to this agreement stipulate that
there shall be appointed as the director of such health unit, a
physician who is a graduate of a Class A (A.M.A. ) medical school
and who holds a degree granted by a recognized university school
of health and who has had at least five yearst successful experience
as an executive in public health administration, provided, however,
it is not the intention of this agreement to in anywise interfere
with the authority vested in the State Board of Health or in the
Board of County Commissioners of Dade County under the provisions
of Chapter 14906 aforesaid;
4. It is understood that the Dade County Health Unit Advisory
Board shall act in an advisory capacity only, but it is the earnest
desire and intention of all of the undersigned parties that the
affairs of said Dade County Health Unit be conducted as nearly
as possible in keeping with the advice and direction of said Advisory
Board, both as to the enforcement of health practices and in the
employment of personnel;
5. The several parties hereto pledge an appropriation for
the period beginning November 10, 1942 and ending June 30, 1943,
as follows:
Board of County Commissioners $ 18,783.00
Dade County Board of Public Instruction 21,083.00
City of Miami 38,331.0n
City of Miami Beach 15,969.00
City of Coral Gables 2,172.00
The money so appropriated by the Boards and the municipalities afore—
said shall be paid in quarterly or monthly installments, in advance,
to the Treasurer of the State of Florida, to be credited to the ac—
count of the Dade County Health Unit;
6. It is the understanding and agreement of the parties
hereto that the primary purpose of forming the Dade County Health
Unit is for the control and eradication of preventable diseases
and to inculcate modern and scientific measures of hygiene and
sanitation for the prevention of communicable diseases and the
enforcement of the state health laws and the enforcement of the

health ordinances of the undersigned municipalities of Dade County.

The above arrangement is concurred in by the State Board of
Health, which Board agrees to use its best efforts and endeavors to
comply with the provisions, purposes and intent of the above agree—
ment in so far as participation by the State Board of Health is
authorized by law.

WHEREAS, the City Council is of the opinion that the expan-
6ion and consolidation of said Dade County Health Unit and the
execution of said agreement by the City are to the best interest
of the City of Miami Beach,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the Mayor of the City of Miami
Beach, Florida, be and he is hereby authorized and directed to
execute said agreement for and on behalf of said City.
