A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, FINDING AND DECLARING THE EXISTENCE
OF AN EMERGENCY AND ALLOWING THE POLICE ATHLETIC LEAGUE
(PAL), A NOT-FOR-PROFIT ENTITY, TO UTILIZE THE PUBLIC SWALE
AREA LOCATED AT DADE BOULEVARD AND PRAIRIE AVENUE, AND
THE DADE BOULEVARD VACANT LOT, LOCATED BETWEEN PRAIRIE
AVENUE AND MERIDIAN AVENUE, FOR A FUND RAISING EVENT TO
PROVIDE ADDITIONAL PARKING AND OPERATE A FOOD CONCESSION
STAND, FROM FEBRUARY 13 - 18, 2003, DURING THE MIAMI
INTERNATIONAL BOAT SHOW; FURTHER PROVIDING THAT THE DADE
BOULEVARD VACANT LOT AND THE SWALE BE UTILIZED
EXCLUSIVELY BY PAL SUBJECT TO THE FOLLOWING CONDITIONS, AS
SET FORTH IN THIS RESOLUTION.
WHEREAS, the Administration received a request from the Miami Beach Police
Athletic League (PAL), a not-for-profit entity, for permission to utilize the Dade
Boulevard Vacant Lot (the Lot) and the public swale area located at Dade Boulevard
and Prairie Avenue (the Swale) for a fund raising event to provide additional parking
and for a food concession stand during the Boat Show, from February 13-18, 2003;
and
WHEREAS, majors events held throughout the City, including the Boat Show
severely impact the surrounding areas and substantially increase the demand for
parking; and
WHEREAS, the increased demand for parking may be alleviated by the
declaration of an emergency in order to temporarily provide additional parking through
the use of the subject areas; furthermore, the subject permission is granted without
establishing precedent; and
WHEREAS, the Administration recommends approval of PAL's request subject
to and contingent upon the following conditions:
1. PAL will hire an off-duty police officer to direct traffic for the ingress and egress
on Dade Boulevard;
2. PAL will restore the lot and the swale in the same condition as it was before the
use;
3. PAL will obtain a General Liability Certificate of Insurance naming the City as
an additional named insured;
4. PAL may elect to charge a preferred parking rate for the Swale and Lot. PAL
will charge $15.00 for the preferred parking spaces and may also elect to
charge a fixed flat fee to reserve a space for the duration of the Boat Show,
primarily targeted for exhibitor use. The flat rate parking fee to be assessed to
users of this facility in the back lot will be consistent with the (City's) Parking
Department's Citywide Boat Show Park and Ride plan. The maximum parking
fee in the back lot should not exceed $10.00 per vehicle/per day;
5. PAL is authorized to operate a food concession stand on the Swale from
February 13-18, 2003; and
WHEREAS, the Administration would herein recommend that the Mayor and
City Commission find that an emergency exists with regard to the scarcity of parking
during special events such as the Boat Show, and that additional need for increased
parking during the duration of these events exists, and therefore approve PAL's
request, subject to the aforestated conditions, on a one time emergency basis.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, finding and declaring the
existence of an emergency and allowing the Police Athletic League (PAL), a not-for-
profit entity, to utilize the public swale area located at Dade boulevard and Prairie
Avenue and the Dade Boulevard vacant lot, located between Prairie Avenue and
Meridian Avenue, for a fund-raising event to provide additional parking and operate a
food concession stand, from February 13 - 18, 2003, during the Miami International
Boat Show; further providing that the Dade Boulevard vacant lot and the swale be
utilized exclusively by PAL subject to the following conditions, as set forth in this
Resolution.

Item Summary/Recommendation:
The PAL is requesting permission to park cars on the Dade Boulevard vacant lot and operate a food
concession stand during the Miami International Boat Show, February 13-18, 2003. The PAL will operate
with the condition that all profits generated by this fund-raising event will go to PAL and Miami Beach Sr.
High School. The PAL will obtain all permits required to operate a food concession stand and provide off-
duty police officers for traffic control. The PAL will also provide a certificate of insurance or proof of
insurance to the City.
The Administration recommends approval of this resolution,

WITHOUT ESTABLISHING PRECEDENT SO AS TO SATISFY THIS
UNIQUE EMERGENCY SITUATION; AND (3) THAT PAL PROVIDE A
CERTIFICATE OF INSURANCE OR OTHER PROOF OF INSURANCE TO
THE CITY.
ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
The Miami Beach Police Athletic League (PAL) has requested permission to use the
private vacant lot, located at 775 Dade Boulevard, between Prairie Avenue and Meridian
Avenue, for parking of vehicles of persons who will be attending the 2003 Miami
International Boat Show, from February 13-18, 2003, and to use the Dade Boulevard
swale to place and operate a food concession from February 13-18, 2003.
The Miami International Boat Show, like other Special Events, increases the parking
problems that occur in the City. The use of this vacant lot for parking for this event would
ease the parking and create less of an inconvenience for those citizens who live in the
area.

In addition, the Police Athletic League will:
1. Hire an off-duty police officer to direct traffic for the ingress and egress on Dade
Boulevard.
2. Restore the property in the same condition as it was before the use.
3. Obtain a General Liability Certificate of Insurance naming the City as an additional

4. PAL may elect to charge a preferred parking rate for use at the swale area and
parking in proximity to the Convention Center. The PAL will charge $15.00 for the
preferred parking spaces and may also elect to charge a fixed flat fee to reserve a
space for the duration of the Boat Show, primarily targeted for exhibitor use. The flat
rate parking fee to be assessed to users of this facility in the back lot will be
consistent with the (City's) Parking Department's Citywide Boat Show Park and Ride
plan. The maximum parking fee in the back lot should not exceed $10.00 per
vehicle/per day.
5. PAL requests authorization to operate a food concession stand on the Dade
Boulevard Swale from February 13-18, 2003, and will obtain any and all necessary
permits to operate a food concession stand.
It is recommended that the Mayor and City Commission adopt this Resolution and permit
PAL to use these properties which would ease the parking problems caused by the Boat
Show and PAL and will be able to raise much needed funds for their operations by offering
this parking and the operations of a food concession stand.
