Resolution 5666 RESOLUTION NO. 5666
WHEREAS, House Joint Resolution No. 786, entitled
"A JOINT RESOLUTION PROPOSING AN AMENDMENT
TO THE CONSTITUTION OF THE STATE OF FLORIDA
TO BE KNOWN 4.S ARTICLE XX, SECTIONS 1-8 THEREOF,
RELATING TO THE CONSOLIDATION OF CERTAIN OFFICES
IN THE COUNTY OF DADE, STATE OF FLORIDA, AND
PROVIDIvG FOR THE ASSESSMENT AND COLLECTION OF
ALL COUNTY, DISTRICT AND MUNICIPAL TAXES BY ONE
TAX ASSESSOR AND ONE TAX COLLECTOR, THE CONSOLIDATION
OF THE OFFICE OF COUNTY PROSECUTOR AND SOLICITOR
WITH THAT OF STATE ATTORNEY, AND COMBINING THE
CLERK OF THE CRIMINAL AND CIVIL COURTS AND DUTIES OF
TAX COLLECTOR WITH THE CLERk OF THE CIRCUIT COURT. "
has been introduced in the House of Representatives at the present
session of the Florida Legislature; and
WHEREAS, the City Council of the City of Yiami Beach is firmly
convinced that the constitutional amendment proposed in said resolu-
tion would be highly detrimental to the best interest of the citizens
and tax payers of the City of Miami Beach; and
brhEhEAS, although strictly local in its effect, the amendment
would be voted upon throughout the State of Florida, and the vast
majority of those voting thereon wouldhave absolutely no interest
in the amendment and as a result thereof would probably vote in favor
of said amendment thus foisting upon the citizens and taxpayers of
the City of Miami Beach an unwelcome interference with the home rule
of this municipality; and
WHEREAS, this City Council is informed that in all probability
the City of Miami would welcome such an amendment but that other
municipalities within the boundaries of Dade County are opposed to
the amendment and to the results of the adoption thereof,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that said body is opposed to the passage
and adoption of said Joint Resolution in its present form and requests
the Senator and Members of the House from Dade County to oppose the
adoption of said Resolution unless and until provision is made therein
for the submission to the electorate of each municipality within the

boundaries of Dade County before such a municipality would become
subject to the provisions of said constitutional amendment and
providing that the provisions of the constitutional amendment would
apply only to those municipalities in which a majority of the voters
participating in an election, duly held for the purpose, voted in
favor of such municipality coming within the operation of the amend-
ment.
BE IT FURTHER RESOLVED that certified copies of this Resolution
be furnished by the City Clerk to Senator Ernest R. Graham and to
Hon. Marshall C. Wiseheart, Hon. C. Vd. Peters and Hon. R. B. Gautier,
Jr. , Members of the House.
