Resolution 5682 RESOLUTION No. 5682 WHEREAS, on the 16th day of June, 1943, the City Council passedand adopted its Resolution No. 5678, reading as follows : "Whereas, the Architect has recommended that an extension of twenty-five (25) days be granted to ivm. S. Green Company in connection withits contract covering Project Fla. 8-249 (N.F. ) , Recreational Facilities at Miami Beach Pier, and Whereas, the Architect having recommended that this extension be formally approved and accepted by the City of Miami Beach, i''lorida, Now, therefore, be it resolved by the City Council of the City of Miami Beach, Florida, that they ac- cept the report of the Architect and approve, ratify and confirm the granting of an extension of twenty- five (25) days to the contract, subject to approval of same by the Federal works Agency. " and ub ±ERkAS, it was the intention of the City Council to in- clude in said Resolution a provision whereby the City of Miami Beach would waive any damages which said. City might sustain and any penal- ties which might be imposed upon Wm. S. Green Company by the terms of said contract, by reason of the extension of twenty-five (25) days granted by said Resolution, NO1+k, I'ri.EHt&ORE, nn; 12 RtSOLVi D by the City Council of the City of Miami Beach, Florida, that said City does hereby waive any damages which might accrue to said City by reason of the delay of twenty-five (25) days in the completion of said contract as contem- plated by said extension and does hereby waive any penalties which might be imposed upon Wm. S. Green Company pursuant to the terms of said contract by reason of the twenty-five (25) days delay in the completion of said contract as contemplated by said Resolution. PASSED and ADOPTED this 7th day of July, A.
