Resolution 5944 RESOLUTION NO. 5944 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, FINDING AS TO THE NUMBER OF FREEHOLDERS LEGALLY QUALIFIED TO PARTICIPATE IN THE SPECIAL ELECTION HELD FEBRUARY 26th, 1946, AND CANVASSING THE RETURNS OF THE SAID SPECIAL ELECTION AND DECLARING THE RESULT TO BE AGAINST THE ISSUANCE OF BONDS IN THE TOTAL SUM OF $2,950,000.00 FOR THE PURPOSES IN THIS RESOLUTION STATED. WHEREAS, the City Clerk and Supervisor of Registration of the City of Miami Beach, Florida, has certified that the total number of freeholders who were qualified electors residing in said City, and legally qualified to participate in the Special Election held in said City on February 26, 1946, was 3711, and WHEREAS, this City Council has made a canvass of the returns of the certificates of the Inspectors and Clerks who held and conducted said Special Election held on February 26th, 1946, such canvass having been made solely, exclusively and entirely from such returns, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that we do hereby find and declare that the total number of the freeholders who were qualified electors residing in said City and legally qualified to participate in the Special Election held in said City on February 26th, 1946, was 3711, and that only 816 of said freeholders qualified as aforesaid entered the polling places and signed the signature certificates as a prerequisite for voting, as required by law and actually entered the booths of the voting machines and participated in the election, as shown and evidenced by the public counters on the voting machines used in said election, and that seven ( 7) of said freeholders qualified as afore- said, cast their absentee ballots, pursuant to law and participated in the election, and BE IT FURTHER RESOLVED that we do hereby find and declare that the total number of votes cast in said election in favor of the approval of the bonds and the total number of votes cast in said election against the approval of the bonds were as follows: Upon the question: 1. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of Five Hundred Thousand ( $500,000.00) Dollars, with interest at a rate hereafter to be determined, not exceeding 3%, per annum, for the purpose of constructing an Auditorium in the City of Miami Beach?" 749 votes were cast, of which 459 votes were "For Bonds" and 290 votes were "Against Bonds" . Upon the question: 2. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of Seven Hundred Fifty Thousand ( $750,000.00) Dollars, with interest at a rate hereafter to be determined, not exceeding 3%, per annum, for the purpose of constructing a Hospital in the City of Miami Beach?" 750 votes were cast, of which 452 votes were "For Bonds" and 298 votes were "Against Bonds" . - 1 - Upon the question: 3. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of Six Hundred Thousand ( $600,000.00) Dollars, with interest at a rate hereafter to be determined, not exceeding 3%, per annum, for the purpose of acquiring and improving, for park purposes, Lot "A" together with the out-lot West of Collins Avenue and East of Indian Creek lying opposite said tract and together with all riparian rights, in the Indian Beach Corporation's Subdivision, accord- ing to amended plat thereof, recorded in Plat Book 8, at page 61, of the Public Records of Dade County, Florida, commonly known as "The Firestone Estate" ? 723 votes were cast, of which 306 votes were "For Bonds" and 417 votes were "Against Bonds" . Upon the question: 4. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of Four Hundred Thousand 0400,000.00) Dollars, with interest at a rate hereafter to be determined, not exceeding 3%, per annum, for the purpose of acquiring and improving, for park purposes, Lots 1, 2, 3, 4 and 5, together with the out-lots West of Collins Avenue and East of Indian Creek lying oppose said tracts and together with all riparian rights, in the Indian Beach Corporation' s Subdivision, according to amended plat thereof, recorded in Plat Book 8, at page 61, of the Public Records of Dade County, Florida, commonly known as "The Warner Property"? 714 votes were cast, of which 289 votes were "For Bonds" and 425 votes were "Against Bonds" . Upon the question: 5. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of Three Hundred Thousand ($300,000.00) Dollars, with interest at a rate hereafter to be determined, not exceeding 3%, per annum, for the purpose of acquiring areas for the purpose of off-street parking of automobiles?" 753 votes were cas , of which 529 votes were "For Bonds" and 224 votes were "Against Bonds" . Upon the question: 6. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of Four Hundred Thousand ($400,000.00) Dol- lars, with interest at a rate hereafter to be determined, not exceeding 3%, per annum, for the purpose of constructing a water storage reservoir and constructing and extending water mains and lines?" 786 votes were cast, of which 655 votes were "For Bonds" and 131 votes were "Against Bonds" . and, WHEREAS, a majority of the total number of freeholders who were qualified electors residing in said City, and legally qualified to parti- cipate in said Special Election, did not vote therein; - 2 - NOW, THEREFORE, BE IT FURTHER RESOLVED that we do hereby declare that the issuance of said bonds in the aggregate sum of $2,950,000.00 has not been duly and legally approved by the voters, as provided by law..
