A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AMENDMENT NO. 2 TO THE
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH, FLORIDA AND SAVINO & MILLER DESIGN STUDIO, P.A., FOR

FUNDING
WHEREAS, on December 9, 2015, the Mayor and City Commission adopted Resolution
No. 2015- 29234, authorizing the negotiation and execution of a Professional Services Agreement
with the firm of Savino & Miller Design Studio, P.A., ( "Consultant "), to provide professional
services for the planning, design, bid, award and construction administration of the Future
Community Park (former Par 3) Project (the "Project "); and
WHEREAS, On May 19, 2016, a professional services agreement was executed in the
amount of $933,465,; and
WHEREAS, on September 5, 2017, the conceptual drawings and renderings for the
project were presented at the Design Review Board ( "DRB ") hearing, and the DRB recommended
the approval of the project with certain conditions and approved a Certificate of Appropriateness;
and
WHEREAS, on January 26, 2018, the City approved Amendment No.1, in the amount of
$32,295, for design services, to incorporate the reduction and reconfiguration of the lake; removal
of the parking lot from the west side of the property; increase the parking along Pinetree Drive;
and reconfigure the walkway and jogging path; and
WHEREAS, on March 7, 2018, the Mayor and City Commission adopted Resolution No,
2018- 30222, accepting the recommendation of the Finance and Citywide Projects Committee
( "FCWPC "), to continue with the current design of the park; and
WHEREAS, as part of the 30% design review, comments were generated by City
departments and the Parks and Recreational Facilities Advisory Board, and the following
additional elements are necessary to be included in the design scope: pathway lighting, interior
and exterior security lighting, tennis court lighting, conduits for the future installation of security
cameras, and revised tennis center building; and
WHEREAS, in addition, the conditions at the site have changed due to Hurricane Irma
debris removal operations, and a revised site survey, tree report, and tree management plans are
necessary; and
WHEREAS, the Consultant submitted a price proposal for additional services for
Amendment No. 2 in the negotiated amount of $35,698, for the design, permitting, bid award and
construction administration of the above described services; and
WHEREAS, City staff has found the proposal to be fair and reasonable; and
WHEREAS, the total contract amount, including the previous amendment, will revise the
contract amount to a not -to- exceed total of $1,001,458.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission
approve and authorize the Mayor and City Clerk to execute Amendment No. 2 to the Professional
Services Agreement between the City of Miami Beach, Florida and Savino & Miller Design Studio,
P.A., for additional Architectural and Engineering Design Services for the Future Community Park
(former Par 3) Project, in an amount not -to- exceed $35,698; with previously appropriated funding.

This Amendment No, 2 to the Agreement, made and entered this 25 day of \-7 2018,
by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of
the State of Florida (hereinafter referred to as City), having its principal offices at 1700
Convention Center Drive, Miami Beach, Florida 33139, and SAVINO & MILLER DESIGN
STUDIO, P.A, a Florida Corporation, having its offices at 12345 NE 6 Avenue, Miami, Florida
33161 (hereinafter referred to as the Consultant).
RECITALS

No. 2.
2. MODIFICATIONS
a. The Agreement is amended to include and incorporate the additional Services, as
set forth in Exhibit 2-1, attached hereto.
b. In consideration for the performance of the additional Services, as set forth in
Exhibit 2 -1, City shall pay the Consultant the total not -to- exceed amount of
$35,698.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION.
The City and Consultant ratify the terms of the Agreement, as amended by this
Amendment No. 2.

RECOMMENDATION
The Administration recommends adopting the Resolution.
ANALYSIS
On December 9, 2015, the Mayor and City Commission adopted Resolution No. 2015- 29234,
authorizing administration to enter into negotiations and further authorizing the Mayor and City Clerk
to execute a Professional Services Agreement with the firm of Savino & Miller Design Studio, P.A.,
(Consultant), to provide professional services for the planning, design, bid, award and construction
administration of the Future Community Park (former Par 3) (the Project).
On May 19, 2016, a professional services agreement was executed in the amount of $933,465.
On September 5, 2017 the conceptual drawings and renderings for the project were presented at the
Design Review Board (DRB) hearing. The DRB recommended the approval of the project with
certain conditions and approved a Certificate of Appropriateness.
On January 26, 2018 the City approved Amendment No.1, in the amount of $32,295, for design
services, to incorporate the reduction and reconfiguration of the lake; removal of the parking lot from
the west side of the property and increase the parking along Pinetree Drive; and reconfigure the
walkway and jogging path.
On February 23, 2018 the Finance and Citywide Projects Committee (FCWPC) approved the
conceptual design and directed staff to continue with the development and permitting of the project.
The committee requested staff to prepare a list of project elements that could be implemented within
the current available budget and to explore Brownfield grants for the remediation efforts.
On March 7, 2018, the City Commission passed Resolution 2018 - 30222, accepting the
recommendation of the FCWPC, to continue with the current design of the park.

As part of the 30% design review, comments were generated by City departments and the Parks and
Recreational Facilities Advisory Board and the following additional elements are necessary to be
included in the design scope:
Pathway lighting along the .52 mile vita course loop
Interior and exterior security lighting at tennis / restroom building
Tennis court Lighting at six (6) tennis courts
• Conduit and control panel to accommodate the future installation of security cameras by others
at the proposed tennis and restroom building
Revised Tennis Center building and bathroom
In addition, the conditions at the site have changed due to Hurricane Irma debris removal operations
and the following scope is necessary to be conducted:
Revised Site Survey
Revised Tree Report
Revised Tree Management plans
The Consultant submitted a price proposal for additional services for Amendment No. 2 (Attachment
A) in the negotiated amount of $35,698, for the design, permitting, bid award and construction
administration of the above described services. City staff found the proposal to be fair and
reasonable.
The total contract amount, including the previous amendment, will revise the contract amount to a
not -to- exceed total of $1,001,458.
CONCLUSION
The Administration recommends the execution of Amendment No. 2, in the not to exceed amount of
$35,698.

SCOPE OF ADDITIONAL SERVICES
Douglas Wood Associates will provide the following additional services:
Structural engineering services for foundations for a series of approximately ten-foot tall
light poles. Services will consist of review of product data for lights and poles (relative to
foundation design), consultation and coordination with other design team members,
structural analysis for foundations, design, preparation of construction documents,
assistance with permitting and bidding and construction administration.
ADDITIONAL FEES

Dear Barry:
Per your request our fee proposal is for the lump sum amount of $15,050.00 for the additional scope of work
described below.
The scope of work included in the fee is the following:
1. Electrical Engineering to include pathway lighting and security lights at the buildings and shelters. The
pathway lighting on the loop trail shall be designed to provide City standard illumination of .6 FC.
The loop trail is approximately 0.53 miles.
2. Security lights at the shelters and at the restroom /tennis center building.
3. Provisions to accommodate the future installation of security cameras. This would include a control
panel placed with a power outlet near a service access to the park, and a 2" conduit 5' to the outside
of the tennis restroom building for future pickup
4. Lighting for six tennis courts.
Not included in our fee:
1. Exclusions from original proposal apply.
Your office will provide to us:
1. Electronic files of drawings and sections in AutoCAD format ready for us to use in order to show our
work.
Our proposed fee breakdown is as follows:
Construction Documents — 50% Completion $4,270.00
Construction Documents — 90% Completion $4,270.00
Construction Documents — 100% Completion $5,035.00

Dear Mr. Miller,
I will provide an updated written tree resource evaluation for the
property known as Par 3 Park in Miami Beach. This will update my original
Par 3 Community Park report dated September 26, 2016.
Based upon the scope of the original report any trees or palms that have
been damaged, failed, changed significantly, or have been removed will
be documented in an additional Appendix to the original report. I will not
remeasure trees or palms that appear to be unchanged.
I will rate the trees and palms in accordance with ANSI A300 (Part 5) —
2012, Annex A, Management Report Information. The trees and palms
will be rated Good, Moderate, or Poor.
I will also follow the Levels and Scope of Tree Risk Assessment from the
ANSI A300 Part 9- 2017: Levels of tree risk assessment; Level 1 limited
visual tree risk assessment, Level 2 basic tree risk assessment, and Level 3

advanced tree risk assessment. The scope of this report/evaluation is
limited to a Level 2 Assessment for all trees and palms onsite.
My fee will not exceed $900 with payment due at the time of digital
delivery to the architect and/or the owner. This fee will include any
subsequent follow-up with the architect or the City of Miami Beach
regarding the tree resource evaluation.
My fee for further work which may include monitoring demolition,
hearings, or meetings regarding tree issues will be $150 per hour.

Dear Barry,
Based on our meeting last week with the Department of Parks and Recreation and the Department of
Capital Irnprovements we request additional services in regards to the proposed design modifications to
the multi-use pavilion.
DESCRIPTION DFITEMS REQUIRING ADDITIONAL SERVICES:
1. Increase in size and use of the proposed multiuse pavUion
a. ncrease square footage of storage room
b. Provide larger electrical room
c. Provido additional staU in Women's Restroom and urinal in Men's Restroom
2. Eliminate aR impermeable shade elements
3. Rearrange the restrooms so that the lavatories are facing the exterior and overall restrooms do
not have doors and is secured with one roU down gate
4. Open up distance between each restroom and office/storage building and elimination of individual
vestibules to the Men's' and Women's Restrooms to allow for better surveillance
ADDITIONAL SERVICES REQUIRED TO ACCOMPLISH:
1. Site visit to Flaming Park to roview the existing restrooms and Iayout which is now the preferred
restroom design
2. Modify restroom design and multiuse building
3. Reconfigure common vestibule and add roll down gates to restrooms and vending machine
