RESOLUTION NO. 5779
W11REAS, the property located in the City of Miami Beach
and known as BAY SHORE GOLF COURSE property, when purchased by
the City of Miami Beach, was subject to a lease dated July 16,
1942, by and between Miami Beach Bay Shore Company, as Lessor,
and the United States of America, as Lessee ; and

WHEREAS, said lease contains, among other things, the fol-
lowing:

"The Government shall not be required to restore
any part of the leased property, except the
buildings now located on said property and the
sprinkler system now located upon the golf course,
which buildings and sprinkler system the Government
shall maintain and keep in good condition during
the term of this lease, and shall return the same
to Lessor at the end of this lease in the same con-
dition as when received. from Lessor, reasonable and
ordinary wear and tear and damages by the elements
or by circumstances over which the Government has no
control, excepted . The Government shall not be re-
quired to restore the golf course grounds . "
and
WHEREAS, the lease is now about to terminate and the United
States of America has offered the sum of Thirty-two hundred thirty
and sixty one-hundredths W.3,230.60) dollars to the City of Miami
Beach, in lieu of restoration by said. United States of America of
said buildings and sprinkler system, to the same condition as when
taken over under the terms of said. lease.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the
City of Miami Beach, Florida, that the City Manager be and he is
hereby authorized to receive and accept , for and on behalf of said
City, from said United States of America, the sum of •x;:3,230.60 in
full settlement of any claims of the City of Miami Beach against
said United States of America on account of the condition of said
buildings and sprinkler system, and in lieu of restoration by said
United States of America of said buildings and said sprinkler sys -
tem.
