Resolution 5836 RESOLUTION NO. 5836
WHEREAS, it has come to the attention of the City Council of
the City of Miami Beach, Florida, that a certain cause entitled "Dade
County, a political subdivision of the State of Florida, plaintiff,
versus Certain Lands Against Which Taxes Are Delinquent, defendant",
now pending in the Circuit Court of the Eleventh Judicial Circuit in
and for Dade County, Florida, involves, among other things, the fore-
closure of certain tax certificates held by the plaintiff therein, on
the following described lands situate and being in Miami Beach, Dade
County, Florida, to-wit :
"From a concrete monument at the intersection of West
line of Jefferson Avenue and the North line of Lincoln
Road go East a distance of 794.10 feet ; thence North
105 feet to point of beginning, run East 50 feet , North
20 feet, West 50 feet, South 20 feet, to the point of
beginning (same being a continuation of 20 foot Lincoln
Lane, as recorded in Plat Book 34, at page 66, of the
Public Records of Dade County, Florida)
and
WHEREAS, the above-described property, although privately owned,
has been used as a continuation of Lincoln Lane as described and de-
lineated on a plat recorded in Plat Book 34, at page 66, of the Public
Records of Dade County, Florida, and it is desirous that such use be
continued in the future for the benefit of the public ; and
WHEREAS, title is now or soon will be vested in the plaintiff in
the above described cause, by virtue of the foreclosure therein; and
WHEREAS, Dade County, acting by and through its County Commissioners;
is empowered by the Laws of Florida to dedicate or deed property vested
in said County for the use and benefit of the public,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Miami Beach, Florida, that the City Clerk be and he hereby is authorized,
empowered and directed to do any and all acts necessary to secure from
the County Commissioners of Dade County, Florida, a deed or dedication
of the above-described property in such form and to such grantees as are
authorized by pertinent laws of Florida so as to assure its continued
use for public purposes and as a continuation of Lincoln Lane.
