Resolution 5843 RESOLUTION NO. 5843
WHEREAS, a certain building has heretofore been erected on
Lots 1 and 2, less the South three feet, which had heretofore been
conveyed on May 29th, 1933, to the City of Miami Beach, Florida,
for street and/or sidewalk purposes, of Block 4-A, First Addition
to Whitman ' s Subdivision of Espanola Villas, as recorded in Plat
Book 9, at page 147, of the Public Records of Dade County, Florida,
otherwise known as Nos. 1440 and 1444 Drexel Avenue and No. 507
Espanola Way, Miami Beach, Florida; and
WHEREAS, a recent survey reveals that the said building en-
croaches upon property of the City of Miami Beach, Florida, con-
tiguous to the South lot line of said property, said encroachment
consisting of three balconies which extend approximately two feet
over the City property; and also two balconies on the East side of
said building which protrude 2.3 feet over City property; and
WHEREAS, it is the opinion of the City Council that the said
encroachment was unintentional,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City
of Miami Beach, Florida, that insofar as said Council has the power
to bind the City of Miami Beach in the premises, no action of any
kind whatsoever shall be taken by the said City to require the owners
of the said property and their heirs, successors or assigns, to move,
or remove, the structures located on said land by reason of said
encroachment.
PASSED and ADOPTED this 2nd day of July, A.D. , 1945.
