Resolution 5908 RESOLUTION NO. 5908 WHEREAS, on October 7th, 1942, a lease was entered into between the City of Miami Beach and the United States of America covering property known as Flamingo Park, together with band shell with stage equipment, outdoor auditorium, shower, dressing room and volley ball courts, as more particularly described in said lease, said lease being known by the Government as Number W2287 ENG-1883; and WHEREAS, notice has been given to the City of Miami Beach • that the United States of America now exercises the right reserved in said lease to give up said premises, effective midnight, Decem- ber 24th, 1945; and WHEREAS, it has been mutually agreed that the Government will deliver to the said City the title to certain improvements which are no longer required by the Government, in partial satis- faction of restoration of said premises ; and WHEREAS, the said City is willing, in lieu of performance by the Government of the restoration required by said lease, to accept said improvements and to accept the sum of $9,044.00 in considera- tion of the difference between the value of said improvements and the estimated cost of restoration; and WHET AS, the Government has prepared and will submit an instrument, in writing, entitled "Supplemental Agreement #1 transferring improvements to Lessor" with the terms of which the City Council of said City is familiar, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that the Mayor and the City Clerk be and they are hereby authorized and directed to execute on behalf of, and in the name of, said City, an acknowledgment of receipt of notice of cancellation of the above-mentioned lease and said Supplemental Agreement #1 transferring improvements to Lessor. -1- PASSED and ADOPTED this 5th day of December, A.
