Resolution 6162 RESOLUTION NO. 6162
WHEREAS, in the January 3rd, 1947, issue of the
Miami Herald notice was given that the Trustees of the Internal
Improvement Fund of the State of Florida will offer for sale,
for objections only, in Tallahassee, Florida, at 11:00 o' clock,
A. M. , February 4th, 1947, land in Dade County, described as
follows:
Commencing at the Northeast Corner of Fractional
Section 3, Township 53 South, Range 42 East,
Tallahassee Meridian in Florida; thence South
1° 41' 45" East along the East Line of Fractional
Section 3 as aforesaid for a distance of 863.68
feet; thence continue South 1° 41' 45" East a
distance of 1,148.92 feet to a point; thence
run North 55° 431 43" West for a distance of
256.310 feet to a point on the bulkhead line of
Biscayne Point ; thence run North 1° 28' 00" West
for a distance of 327.202 feet to a point of cur-
vature; thence deflecting to the left along the
arc of a curve the radius of which is 240 feet
and a central angle of 900 00' 00" for an arc dis-
tance of 376.991 feet to the point of tangency;
thence run South 88° 321 00" West a distance of
2,325.00 feet to the point of beginning of the
tract of land herein described; thence deflecting
to the right along the arc of a curve having a
radius of 200 feet and a central angle of 1800 00' 00"
for an arc distance of 628.319 feet to a point of
tangency; thence run South 88° 321 00" West along
the tangent to aforesaid curve a distance of 250.00
feet to a point of curvature ; thence deflecting to
the left along the arc of a curve having a radius
of 200 feet anda central angle of 1800 001 00"
for an arc distance of 628.319 feet to a point of
tangency; thence run North 88° 32' 00" East along
said tangent a distance of 250.00 feet to the point
of beginning, containing 2.296 acres.
and
WHEREAS, the City Council of the City of Miami Beach,
Florida, is of the opinion that the sale of said lands and the
development thereof would be detrimental to the interests of
said City and of the citizens thereof,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that objections be and the same are
hereby made to the proposed sale of said lands by said Trustees,
on the following grounds, to-wit :

1. All of the said lands were in the year 1913, and
were at the time of the recent filling in by the developers of
the adjoining subdivision, covered by water more than three (3)
feet in depth at high tide.
2. That the unlawful filling in of said lands by said
developers prior to the sale of said lands by said Trustees is
' an attempted evasion of the provisions of the Statutes and should
not be sanctioned by said Trustees.
3. That the development of said lands will injure and
obstruct the rights of all the people of the State of Florida in
and to the use of said lands for the purpose of navigation, com-
merce and fishing.
4. That the waters covering said lands prior to the recent
unlawful filling in thereof were navigable waters.
BE IT FURTHER RESOLVED that the City Attorney be and he is
hereby instructed to file objections to said proposed sale with the
Trustees of the Internal Improvement Fund of the State of Florida
and forward to said Trustees a certified copy of this Resolution.
