Resolution 6163 RESOLUTION NO. 6163
WHEREAS, in the January 3rd, 1947, issue of the Miami.
Gerald notice was given that the Trustees of the Internal Im-
provement Fund of the State of Florida will offer for sale, for
objections only, in Tallahassee, Florida, at 11:00 o' clock A.Wi. ,
February 4th, 1947, land in Dade County, described as follows :
Commencing at the Northwest Corner of
Fractional Section 2, Township 53 South,
Range 42 East , Tallahassee Meridian in
Florida; thence South 1° 41' 45" East
along the West Line of Fractional Section
2, as aforesaid for a distance of 532.350
feet to the Point of Beginning of land
herein described; from said Point of Be-
ginning, thence run South 1° 411 45" East
along the West Line of said Fractional
Section 2 as a continuation of the afore-
said course, a distance of 25.000 feet
to a point; thence run North 88° 181 15"
East for a distance of 1,217.220 feet to
a point; thence run North 4° 041 30" West
for a distance of 43.536 feet to a point;
thence run South 87° 25' 55" West for a
distance of 1,215.548 feet to the Point
of Beginning, containing 0.956 acres.
and
WIEREAS, the City Council of the City of Miami Beach,
Florida, is of the opinion that the sale of said lands and the
development thereof would be detrimental to the interests of
said City and of the citizens thereof,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that objections be and the same are
hereby made to the proposed sale of said lands by said Trustees,
on the following grounds, to-wit :
1. All of the said lands were in the year 1913, and were
at the time of the recent filling in by the developers of the
adjoining subdivision, covered by water more than three (3) feet
in depth at high tide.
2. That the unlawful filling in of said lands by said
developers prior to the sale of said lands by said Trustees is
an attempted evasion of the provisions of the Statutes and should
not be sanctioned by said Trustees.

3. ' gat the development of said lands will injure and
obstruct the rights of all the people of the State of Florida
in and to the use of said lands for the purpose of navigation,
commerce and fishing.
4. That the waters covering said lands prior to the
recent unlawful filling in thereof were navigable waters.
BE IT FURTHER RESOLVED that the City Attorney be and
he is hereby instructed to file objections to said proposed
sale with the Trustees of the Internal Improvement Fund of the
State of Florida and forward to said Trustees a certified copy
of this Resolution.
