Resolution 6341 RESOLUTION No. 6341
WHEREAS, the City Council of the City of Miami Beach,
Florida, is considering amending and changing certain of the
regulations and restrictions established and contained in Ordinance
No. 289, commonly known as the "Zoning Ordinance of the City of
Miami Beach, Florida" as hereinafter set forth, to-wit :
To Amend Section 1 of said Ordinance by adding thereto, at
the end thereof, the following:
"CABARET: The term "Cabaret" shall mean a restaurant ,
dining room or other establishment, other than a_ nightclub, where
floor ahcmis or other forms of entertainment are provided in air-
conditioned and sound-proofed rooms for guests at any
time between the hours of midnight and 2:00 o' clock

AND to amend that portion of Section of Ordinance 289
of said City, reading as follows:
"CLUB, NIGHT: The term "Night Club" shall pertain to
and include restaurants, dining rooms or other similar
establishments where floor show or other form of lawful
entertainment is provided for guests after 11:00 o' clock

so as to read aa follows:
"CLUB, NIGHT: The term "N.ght Club" shall mean
any restaurant, dining room or other similar estab-
lishment where floor shows, or other forms of en-
tertainment are provided for guests at any time
between the hours of 2:00 o' clock A. T . and 6:00
o' clock A. L,';."
AND to amend that portion of Section 5 of said Ordinance
289 reading as follows:
"4. Hotels with one hundred (100) or more guest
rooms, may contain business establishments of
the "BAA" Classification providing the exterior
of the building shall not contain store fronts
or have the appearance of commercial or mercan-
tile activities or any display of articles or
services for sale which are visible from the
exterior of the building or on the grounds fac-
ing a public highway or w ater frontage, and
providing further that businesses established
under the provisions of this section shall only
be entered from within the building. "
so as to read as follows :
"4. Hotels with one hundred ( 100) or more guest
rooms, may contain cabarets, as in this
ordinance defined, and business establishments
of the "BAA" Classification providing the
exterior of the building shall not contain
store fronts or have the appearance of commer-
cial or mercantile activities or any display
of articles or services for sale which are
visible from the exterior of the building or
on the grounds facing a public highway or water
frontage, and Providing further that businesses
established under the provisions of this section
shall only be entered from within the building. "

NOW, THEREFORE, BE IT RESOLVED by the City Liouncil of the
City of Miami Beach, Florida,_. that a public hearing be and is hereby
called to be held on the 6th day of August A. D. 1947, at 10:00
o' clock A. M. in the Council Chambers, in, the City Hall, Miami Beach,
Florida, for the consideration of said amendment.
BE IT FURTHER RESOLVED that the City Clerk be and he is hereby
directedto give at least fifteen days notice of the time, place and
object of said hearing by publishing notice thereof in the Evening Sun
and Daily 'Tropics, a newspaper of general circulation in said City of
Miami Beach, Florida, in conformity with Section 21 of Ordinance 289
of said City.
