Resolution 6306 RESOLUTION NO. 6306 WHEREAS, The Railroad Commission of the State of Florida, under its interpretation of the provision of Section 323.29, Florida Statutes, 1941, has assumed and is exercising jurisdic- tion and control over persons operating motor vehicles between three or more cities or towns even though the boundaries of each of such cities or towns adjoin the boundaries of one of the others, and WHEREAS, such an interpretation and such assumption of juris- diction by the Railroad Commission prevents control by the cities and towns of local carriers and the cities and towns are deprived of revenue from taxes and fees from such carriers, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that the Members of the Legislature of the State of Florida be and they are hereby requested and urged to enact such legislation as will exempt from the provisions of Chapter 323 Florida Statutes, 1941, and from the jurisdiction and control of the Railroad Commission of the State of Florida, all persons operating motor vehicles within the corporate limits of any city or town or the adjoining suburban territory, as defined by Chapter 22842, Laws of Florida, Acts of 1945, or between any two or more cities or towns in the same county whose boundaries adjoin the boundaries of any one of the others and the adjoining suburban territory.
