Resolution 6533 RESOLUTION NO. 6533 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, FINDING AS TO THE NUMBER OF FREEHOLDERS LEGALLY QUALIFI} D TO PARTICIPATE IN THE SPECIAL ET,FCTION HELD FEBRUARY 24TH, 1948 , AND CANVASSING THE RETURNS OF THE SAID SPECIAL ELECTION AND DECLARING THE RESULT TO BE AGAINST THE ISSUANCE OF BONDS IN THE TOTAL SUM OF $2,563,000.00 FOR THE PURPOSES IN THIS RESOLUTION STATED. WHEREAS, the City Clerk and Supervisor of Registration of the City of Miami Beach, Florida, has certified that the total number of freeholders who were qualified electors residing in said City, and legally qualified to participate in the Special Election held in said City on February 24, 1948, was 4347, and WHEREAS, this City Council has made a canvass of the returns of the certificates of the Inspectors and Clerks who held and conducted said Special Election held on February 24th, 1948, such canvass hav- ing been made solely, exclusively and entirely from such returns , NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that we do hereby find and declare that the total number of the freeholders who were qualified electors residing in said City and legally qualified to participate in the Special Election held in said City on February 24th, 1948, was 4347, and that only 1620 of said freeholders qualified as aforesaid entered the poll- ing places and signed the signature certificates as a prerequisite for voting, as required by law, and actually entered the booths of the voting machines and participated in the election, as shown and evidenced by the public counters on the voting machines used in said election, and that one (1) of said freeholders qualified as aforesaid, cast an absentee ballot, pursuant to law and participated in the election, and BE IT FURTHER RESOLVED that we do hereby find and declare that the total number of votes cast in said election in favor of the approv- al of the bonds and the total number of votes cast in said election against the approval of the bonds were as follows: Upon the question: 1. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $200,000.00 with interest at a rate hereafter to be determined, not exceeding 31% per annum, for the purpose of constructing and extending Water Mains and lines?" 1522 votes were cast, of which 1346 votes were "For Bonds" and 176 votes were "Against Bonds". Upon the question: 2. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $560,000.00 with interest at a rate hereafter to be determined, not exceeding 31% per annum, for the purpose of constructing Storm Sewers?" 1505 votes were cast, of which 1337 votes were "For Bonds" and 168 votes were "Against Bonds". - 1 - Upon the question: 3. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $90,000.00 with interest at a rate hereafter to be determined, not exceeding 30 per annum, for the purpose of paving portions of each of the follow- ing highways : 17th Street from Meridian Avenue to Washington Avenue ; Meridian Avenue from Lincoln Road to Dade Boulevard?" 1427 votes were cast, of which 1138 votes were "For Bonds" and 289 votes were "Against Bonds". Upon the question: 4. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $65,000.00 with interest at a rate hereafter to be determined, not exceeding 3- % per annum, for the purpose of widening Collins Canal bridge at Meridian Avenue?" 1402 votes were cast, of which 1083 votes were "For Bonds" and 319 votes were "Against Bonds". Upon the question: 5. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $8,000.00 with interest at a rate hereafter to be determined, not exceeding 3*% per annum, for the purpose of constructing a White Way Lighting System on 17th Street from Meridian Avenue to Washington Avenue?" 1422 votes were cast, of which 1107 votes were "For Bonds" and 315 votes were "Against Bonds". Upon the question: 6. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $181,000.00 with interest at a rate hereafter to be determined, not exceeding 3i% per annum, for the payment of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abut- ting property, for the purpose of paving portions of each of the following high- ways: 17th Street, from Meridian Avenue to Jefferson Avenue; Pine Tree Drive from Dade Boulevard to 26th Street; Abbott Avenue, from Indian Creek Drive to 71st Street; Abbott Avenue, from 71st Street to 73rd Street; Harding Avenue, from 73rd Street to 75th Street; Harding Avenue, from 75th Street to 87th Terrace?" 1408 votes were cast, of which 1139 votes were "For Bonds" and 269 votes were "Against Bonds". Upon the question: 7. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $459,000.00 with interest at a rate hereafter to be determined, not exceeding 30 per annum, for the payment of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abutting property, for the purpose of constructing a white way lighting system on the following highways: 5th Street, - 2 - from Alton Road to Ocean Drive; 41st Street, from Alton Road to Pine Tree Drive; Collins Avenue, from 63rd Street to 75th Street; 71st Street and Ever- glades Concourse, from Rue Notre Dame to Collins Avenue; Collins Avenue, from Biscayne Street to 23rd Street; Alton Road, from 5th Street to Collins Canal; Meridian Avenue, from Lincoln Road to Collins Canal; 17th Street, from Washington Avenue to Collins Avenue; Everglades Concourse, from Rue Notre Dame to North Bay Causeway (formerly known as 79th Street Causeway) ; Collins Avenue, from 75th Street to 87th Terr- ace; Drexel Avenue from 12th Street to Lincoln Road; Pennsylvania Avenue, from 7th Street to Lincoln Road; Euclid Avenue, from 5th Street to Lincoln Road; Jefferson Avenue from 5th Street to 11th Street and from 15th Street to Lincoln Road; Michigan Avenue, from 5th Street to 11th Street and from 15th Street to Lincoln Road; Lenox Avenue, from 15th Street to Lincoln Road; 6th Street, from Washington Avenue to Michigan Avenue; 7th Street, from Pennsylvania Avenue to Michigan Avenue; 8th Street from Pennsylvania Avenue to Michigan Avenue; 9th Street, from Washington Avenue to Michigan Avenue; 10th Street, from Washington Avenue to Michigan Avenue; 11th Street, from Drexel Avenue to Michigan Avenue; 12th Street, from Drexel Avenue to Meridian Avenue; 13th Street, from Washington Avenue to Meridian Avenue; 14th Street, from Washington Avenue to Meridian Avenue ; 14th Place, from Pennsylvania Avenue to Meridian Avenue; 15th Street, from Washington Avenue to Alton Road; 16th Street, from Washington Avenue to Alton Road; Pine Tree Drive, from Dade Boulevard to 26th Street; Meridian Avenue from 5th Street to Lincoln Road?" 1409 votes were cast, of which 1114 votes were "For Bonds" and 295 votes were "Against Bonds". Upon the question: 8. "Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $1,000,000.00 with interest at a rate hereafter to be determined, not exceeding 30 per annum, for the purpose of constructing an auditorium, in addition to negotiable coupon bonds in the amount of $750,000.00 heretofore authorized and issued for the same purpose?" 1386 votes were cast, of which 1035 votes were "For Bonds" and 351 votes were "Against Bonds". and, WHEREAS, a majority of the total number of freeholders who were qualified electors residing in said City, and legally qualified to participate in said Special Election, did not vote therein; - 3 - NOW, THEREFORE, BE IT FURTHER RESOLVED that we do hereby declare that the issuance of said bonds in the aggregate sum of $2,563,000.00 has not been duly and legally approved by the voters, as provided by law.
