AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER '106 OF
THE MIAMI BEACH CITY CODE ENTITLED "TRAFFIC AND
VEHICLES" BY AMENDING ARTICLE II THEREOF ENTITLED
"METERED PARKING", BY AMENDING DIVISION I ENTITLED
"GENERALLY", BY AMENDING SECTION '106-55 (L), ENTITLED
"EXCEPTIONS" BY PROVIDING FOR PARKING SMART CARD
PROGRAM INCENTIVES AND AUTHORIZING THE CITY MANAGER
TO ALLOW PARKING INCENTIVES FOR SPECIFIC INITIATIVES
SPONSORED AND/OR PROMOTED BY THE CITY; PROVIDING FOR
REPEALER, CODIFICATION, SEVERABILITY, AND AN EFFECTIVE
DATE.
WHEREAS, the City of Miami Beach has established parking programs and
regulations, rates, fees, and fines associated with on-street and off-street parking, both
administratively and through actions of the Mayor and City Commission; and
WHEREAS, the City of Miami Beach's Parking System has grown substantially
over the last five years, both in services provided to the parking public and revenues
dedved from said services; and
WHEREAS, it is in the best interest of the City of Miami Beach to establish
additional parking programs and regulations, rates, fees, and fines that embody the
City's parking programs and regulations, fees, and fines previously established; and
WHEREAS, the proposed amendments include: establishing Parking Smart
Card Program Incentives; and authorizing the City Manager to allow parking incentives
for specific initiatives sponsored and/or promoted by the City; and
WHEREAS, the Parking and Transportation Committee, an advisory committee
of the City of Miami Beach appointed by the Mayor and City Commission, have
recommended the adoption of the proposed revisions to the ordinance.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND ClTY
COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA, AS FOLLOWS:
SECTION 1. That Section 106-55 of Chapter 106 of the Miami Beach City Code, is
hereby amended to read:
Sec. 106-55 Parking Rates, Fees, and Penalties
(L) Exceptions:
Parking Incentive Program. The City Manager is authorized to designate
"Resident Parking Days" (evening 6:00 P.M. to 12:00 Midnight) for Miami
Beach Residents (proof of residency required) at all Attended Garages
and Lots and Residential Decal holders at on-street meters and/or off-
street metered facilities and identify an incentive to be combined with
specific initiatives sponsored and/or promoted by the City of Miami Beach
to stimulate local businesses dur ng off-peak periods.
Smart Card Program/Commercial Smart Card Resale
Distribution of Residential Smart Card Program.

stations at participating commercially licensed establishments within
the City for the sale/replenishing of smart cards. Commercial
establishments must consent to smart card sales/replenishing rules
and regulations. Commemial establishments are only entitled to profit
share via the resale program. Commercial establishments
participatin.q in the sales/replenishing program are not entitled to any
proceeds or discounts.
Residential Smart Card Program. A discount of ten percent (10%)
may be authorized by the City Manager to all City of Miami Beach
residents (proof of residency required) to be purchased at the Parking
Department and through the Internet, when available.
SECTION 2. INCLUSION IN THE CITY CODE. It is the intention of the Mayor and City
Commission, and it is hereby ordained that the provisions of this Ordinance shall
become and be made part of the Code of Ordinances of the City of Miami Beach as
amended; that the sections of this Ordinance may be renumbered or relettered to
accomplish such intention; and that the word "ordinance" may be changed to "section"
or other appropriate word.
SECTION 3. REPEALER. All Ordinances or parts of Ordinances in conflict herewith
are repealed.
SECTION 4. SEVERABILITY. If any section, subsection, clause or provision of this
ordinance is held invalid, the remainder shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE.

Issue:
IWhether to approve an amendment to the parking rate ordinance to provide for Parking Smart Card
Program Incentives; authorize the City Manager to allow parking incentives for specific initiatives sponsored
and/or promoted by the City. Said initiatives are to promote tourism by further facilitating parking for
visitors and tourists and for the betterment of transportation and parking within the City during major events
that temporarily increase the demand for parking.
Item Summary/Recommendation:
Amend the parking rate ordinance to include the following incentive programs: Parking Incentive Program
allowing for incentives during City sponsored and/or promoted events; Parking Smart Card Programs
allowing a ten percent (10%) discount on the purchase of smart cards for both commercial resale at
participating establishments and CMB residents (with proof of rasidency). The MBRTF (Mayor's Blue
Ribbon Task Force) on Tourism, its sub-committee, and the Transportation and Parking Committee have
endorsed these recommendations.
The Administration recommends that the City Commission approve the amendment of the
ordinance on second and final reading.

ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission approve the amendment of
the ordinance on second and final public hearing.
ANALYSIS:
The Mayor and Commission approved the proposed amendments at the January 8, 2003,
Commission Meeting. The MBRTF (Mayor's Blue Ribbon Task Force) on Tourism
established a Parking Sub-Committee to develop recommendations in order to promote
tourism by further facilitating parking for tourists and residents. To date, various
recommendations have been implemented, including posting of additional signs/materials
to enhance the promulgation of parking regulations, expansion of parking meter time limits
from two to four hour maximum time limits, film and print industry [parking] incentives, etc.
The following recommendations require an amendment of the current Parking Rate
Ordinance. The MBRTF (full committee), MBRTF Parking Sub-Committee, and TPC
(Transportation and Parking Committee) have endorsed the following recommendations:
Parking Incentive Program.
· Authorize the City Manager to designate a "Miami Beach Resident Parking
Day" (evening 6:00 P.M, to 12:00 Midnight) for Miami Beach Residents (proof

of residency required) at all Attended Garages and Lots and Residential
Decal holders at on-street meters and/or off-street metered facilities and
identify an incentive to be combined and leveraged with specific initiatives
sponsored and/or promoted by the City of Miami Beach to stimulate local
businesses during off-peak periods. The intent is to provide [parking]
incentives to encourage participation of events such as Restaurant Month,
Wine Week, and/or any other City sponsored and/or promoted event during
off-peak days/hours.
Parkin,q Smart Card Pro;Irams:
· Smart Card Dispensing/Replenishing Stations/Commercial Smart Card Resale
Program:
Establish smart card discount of ten percent (10%) for distribution at retail
outlets. A profit share incentive will encourage participation of commercial
establishments (local shops, restaurants, and hotels) to offer the parking smart
card. Authorize the Parking Department to place smart card
dispensing/replenishing stations at participating commercially licensed
establishments within the City for the sale/replenishing of smart cards.
Commercial establishments must consent to smart card sales/replenishing rules
and regulations. Commercial establishments are only entitled to profit share via
resale program. Commercial establishments participating in the
sales/replenishing program are not entitled to any proceeds or discounts.
· Resident Smart Card Program:
Establish smart card discount of ten percent (10%) to all City of Miami Beach
residents (proof of residency required) to be purchased at the Parking
Department and through the Internet, when available.
Fiscal Impact of Proposed Amendments
The following are the estimated fiscal impacts to the Parking Enterprise Fund if these
initiatives are instituted:
· Parking Incentive Program:
It is estimated that the Parking Enterprise Fund would forego revenues in the
amount of $2,718 per event. An event is defined as one six hour period from
6:00 P.M. to Midnight on an off-peak night such as Monday, Tuesday, or
Wednesday at on-street and/or off-street facilities.
· Parking Smart Card Programs
It is estimated that the Parking Enterprise Fund would forego revenues in the
amount of $67,177 annually upon implementation of the smart card discount for
both commercial and residential incentives.

CONCLUSION:
In conclusion, the Administration recommends that the Mayor and City Commission
approve the amendments to the parking rate ordinance on second and final reading to
include the proposed Parking Incentive Program and Parking Smart Card Program. The
MBRTF, its sub-committee, and the Transportation and Parking Committee have endorsed
these concepts and urge their implementation.
